Secretary of State Philip Cook on
Saturday was served by a deputy
sheriff with a mandamus from Judge
J. T. Pendleton, of the Superior
Court, ordering him to show cause
whyghe should not grant to the
North Georgia Mineral Raliroad, a
1. and N. property, a charter per
mitting it building an extension from
near Cartersville into Atlanta
This was the latest move of the
Loulsville and Nashville Rallroad to
CArry out its scheme to paraliel the
Western and Aslantic Rallroad into
Atlanta.
Attorneys King and Spalding. rep
resenting the Loulsville and Nash
ville road, presented the petition for
mandamus to Judge Pendieton Fri
day afternoon at his home, where he
signed it
" Judge Pendiston set the hearing on
the petition for January 15, when
Secretary Cook will appear before
him.
The court will decide then whether
to enforce the mandamus against the
Mate and force the issuance of the
charter.
The North Georgia Mineral Rall
road is purposed to extend from Wof
fords Crossing, in Bartow County
near Cartersville, to Atlanta, It will
connect with the Louisville and Nash
ville line at Woffords Crossing, and
give the L. and N. a system from
Knoxville to Atlanta. This competing
road west would weaken the value of
the Western and Atlantic, now leased
to the Nashville, Chattanooga and St
Louls Rallway and controlled by the
L and N.

City Health Cficer J. P. Kennedy's
report for 1915, given out Saturday,
shows that Atlanta is one of the
healthiest cities in the country, with
only 21 deaths from typhoid and a
minimum frcm all other causes ex
cept consumption, which took off 392
persons in the total of. 2,776 deaths
In 1911 there were 90 deaths from
trphoid.
The consolidated death rate is 14.56
persons per 1,000, and the race rate is
1111 for whites and 19.51 for negroes
The consolidated death rate in 1914
was 1581,
“Atlanta's death rate is higher than
it should be because we keep tuber
culosis sanitariums that nearly al
ways are full” explained Dr. Ken
nedy “Many mighboring places
have no provision for treating con
sumption, 8o that we get most of their
cases. | recommend a continued
strong fght against the white plague.
