The State Rallroad Commission
Monday filed in Superior Court a de
‘murrer to the injunction suit recently
brought against it by the Louisville
and Nashville Ralilroad, and asked
that the action be thrown out of court.
~ The railrond company obtained a
temporary injunction against the
\mmmlsslon, restraining it from en
forcing an order to force the rails
road to build a spur track to a manu
facturing plant in Ball Ground, Chere
okee County. The commission’s de
murrer, which was filed by Judge
James K. Hines, was based on the
contention that the commission has
full authority to compel a railroad
company to build a spur track, The
rallroad asserted that the commission
was without authority in such mat
ters,
