’ CAINBSVILLE, Ga., Feb, 26.~
i’lu-pm;. Sheriff W. J. Dorsey was
| fatally shot yesterday afternoon in
attempt to arrest Ott Darnell and J.
B. Brown, who, it was staed, were
causing a disturbance at the Galines
ville Cotton Mills.
{ Dorsey was called to quiet the dis
,Lurimr:, who left the mill before his
arrival. Mr. Dorsey followed them
and had a struggle with Brown, Dar
nell, it is alleged, came to the as
sistance of Brown, pulled his gun and
fired, the bullet taking effect in Dor
sey's stomach. Dorsey was carried
to a local hospital and died about two
hours later,
Brown and Darnell after a chase of
about six hours were captured this
morning at 4 o'clock at the home of
a Mre, Phillips about a half mile
from “Last Chance.” Sheriff W. A.
I(‘,row, Homer Strickland and the en
tire night force went to the home
(and threatened to break the doors
down before any response could be
had,
Brown and Darnell are in the
‘nounty jail and refyse to make any
statement about the tragedy,
. Dorsey’s wife and six children are
in bed with the influenza and are in
a precarious condition.

constitutes disability of the Presi
dent of the United States and legis
lation necessary to fill the office dur
ing such disability were to be con
gidered by the House Judiciary Com
mittee at hearings which opened to
day.
The committes has before it an
amendment to the constitution, pro
posed by Representative Fess of
Ohio, which. would authorize the
United States Supreme Court to de
cide the question of the disability of
a President on request of Congress,
and with such decision of disability
the vice president or the cabinet
officer in succession shall assume
the duties of the President during
the period of the disability,
It has a number of resolutions on
the same subject presented to the
House by various members, chiaf
among them being the resolution of
fered by Representative Madden of
Ilinois, which provides gimply for a
definition by Congress of what con
stitutes “disability” on the part of the
President and automatic succession
to the Presidency of the vice presi
dent or a cubinet officer next in
succession when the disability as de
fined shall arise,
A resolution by Representative
Pritten of Illino's would make it a
disability within the meaning of the
construction for any President to
absent himself from the territorial
limits of the United States for thirty
days or more, or to be confined by
illness for a like period.
