'u Brown, who, it was staed, were
causing a disturbance at the Gaines

| Dorsey was called to qulet the dis

arrival, Mr. Dorsey followed them
and had a struggle with Brown, Dar
;nr-n, it is alleged, came to the as
slgtance of Brown, pulled his gun and I
fired, the bullet taking effect in Dor
sey's stomach, Dorsey was carried
to a loeal hospital and died about two
hours later,
Brown and Darnell after a chase of
about six hours weres captured this
morning at 4 o'clock at the home of
a Mrs, Phillips about a half mile
from *“Last Chance.” Sheriff W, A.
Crow, Homer Strickland and the en
tire night forve went to the home

constitutes disability of the Presi
dent of the United States and legis
lation necessary to fill the office dur
ing such disability were to be con
gidered by the House Judiciary Com
:’nlttee at hearings which opened to
ay.
The ecommittee has befors it an
amendment to the constitution, pro
posed by Representative Fess of
Ohlo, whieh would authorize .the
United States Supreme Court to de
cide the question of the disability of
’a President. on request of Congress,
and with such decision of disability
' the vice president or the cabinet
officer in succession shall assume
}lhe duties of the President during
‘the period of the disabllity.
It has a number of resolutions.on
the same gubject presénted to the
House by various members, chiaf
among them being the resolution of
fered by Representative Madden of
Illinois, which provides simply for a
definition by Congress of what con
stitutes “disability” on the part of the
President and automatic succession
to the Presidency of the vice presi
dent or a cabinet officer next In
succession when the disability as de
fined shall arise,

Britten of Illino's would make It a
disability within the meaning of the
construction for any President to
absent himselt from the territorial
limits of the United States for thirty
