Hugh B. Lincoln, of 48 Park avenue,
for tho past four years connected with
the firm of John Sllvey & Co., escaped
Wednesday afternoon about 4 o'clock
from the Presbyterian hoepltal while
In a delirium, and, despite an energetic
search by friends and the police, no
trace of him has been found.
Lincoln,fled from the hoepltal In hie
shirt sleeves at a favorably opportuni
ty, when no one was watching him. A
description of the missing patient was
furnished the police and the members
of the force were directed to keep a
lookout for him.
Lincoln was taken 111 recently and
for the past three weeks has been an
Inmate of the Presbyterian hospital.
Wednesday he grew worse and his
mind became affected.
Shortly after 4 o’clock his nurse dis
covered his room empty and a search
was made for him. Every conceivable
place In the hospital, where a man
might hide, was searched, but the pa
tient could not be found. The escape
was then reported to tho police and
their aid enlisted In the search.
The missing man resides at 49 Park
avenue.

Three Interesting points concerning
new counties are decided In a decision
Landed down by the supreme court on
Wednesday morning In the case of
Moore ve. the State from Crisp supe
rior court.
The three points decided are as fol
lows;
1. A merchant paying for a telephone
Into a dry county, who undergoes the
expanse of persons In dry county using
phone for ordering liquors. Is not guil
ty of soliciting business.
2. A person selling whisky In a dry
county cannot be convicted of selling
liquor without a license, as auch coun
ties do not grant license. If guilty In
any particular It la of violation of lo
cal option law*.
I. A new county created out of a dry
county Is also dry until the lesue Is de
cided by the people In a regular elec
tion.
Representative J. T. H|ll represented
Moore In the action In the superior
court. He demurred to 2he Indictment
for “selling liquor without a license.”
The supreme court reversed Judge Lit
tlejohn In refusing to grant the de
murrer.
Moore conducts a saloon at DeSoto,
Sumter county. He pays tolls on all
orders telephoned him from Cordele,
which Is now In Crisp county. The
court holds that the telephone le an
inanimate vehicle of' transmission tor
such orders, and that the owner of the
same cannot be prosecuted for using
It tor that purpose.

EHOM CANDIDATES
A number of county Democratic ex
ecutive committees laboring under a
misapprehension have written several
state-house officials for eume from one
to three dollars to print tickets for the
state primary.
As a matter of fact. Chairman M. J.
Yeomans has already had printed and
sent out tickets containing all candi
dates for state position*, and the coun
ties will not have to print tickets, save
where county primaries are to be held
at the same time.
