Oober, of the Blue Ridge circuit, who la presid ing during the nhsenca of Judge Pen dleton, Saturday morning, to prevent the Louisville and Nashville railroad, the Ferro-Conerete and Construction Company, the city of Atlanta and tbe Georgia Railway and Electric Company from taking poraesaton of Waverly place, near Washington atreet, and from blockading the free passage and use of sold street; from removing or placing railroad tracks and In any manner Interfering with the said street until a hearing can be held upon the case by Judge Pendleton In the supe rior court on September $. The re- straining order wa* Issued as the result of a petition to the effect tiled by Ger- siicn Brothers' Company. The Gershon Company occupies * tlnee-atory brick balldlng on overly Place, close to Washington street, with a lease which doe* not expire for two years. A few week* ago the Louisville and Nashville began the construction of a warehouse on the atreet and the city voted to construct a viaduct as an extension of Washington street. The city council voted to close Waverly place on condition that the railroad company grant a deed of land close by for a new Waverly place. The p*a- tloners claim that in order to obtain the consent of the mayor and the city council to make such change, the rail way company falsely end fraudulently represented to the mayor and counsel that It was the sole owner and In pos session of all property abutting on Waverly place. The petitioners, further allege that the new Waverly place has not been deeded tb the city, sidewalks have not been graded, no curbing laid down, sidewalks laid out or the street paved, as ordered by the t.*y council. Tito Ueorgla Railway and Electric Company Is tearing up Its tracks through the old Waverly place and the Louisville and Nashville Company, through the Ferro concrete Construction Company, Is laying Its own tracks thereon.
