State Is Balked in Probing
By Ruling of the
Court.
• Findlay, Ohio, Oct. 16.—Much to the
surprise of all, and the defenae In par
ticular, the attorneys for the prosecu
tion In the case of the State aftalnat
the Standard Oil Company for "ron-
apiracy against trade," have announced
that the state will conclude Its testi
mony today.
Although they said they would aub-
pena no witnesses, yet the fact has
leaked out that the defense will exam
ine a doxen Independent witnesses.

ing of Judge Banker from offering a
line of evidence Intended to show that
the Standard gave secret rebates to
retail dealers In oil.
Mr. Phelps, for the proseeuilon, ad
mitted the state had no means of show
ing that the Standard Oil Com|*ny
authorlsed Its agents to offer to give
rebates. The court said It was a fun
damental rule of evidence that the au
thority of the agent must be eatab-
. Halted.
It was testified to by officers of the
Buckeye Pipe Line and Ohio oil com
panies that the Standard oil Company
of New Jersey, owned practically all
of the stocks of these companies. This
, was the most Important development
of the trial. An agreement has been
reached between the prosecutors and
defendants wherein the cane against
j John D. Rockefeller will not be set for
! trial until after the present case has
I been finally disposed of.

1 nesses this morning, the prosecution
rested Its case, and the defense Imme
diately began. The arguments waxed

Blyslone, the 10-year-old son of Cyrus
fUyslone, who three weeks ago stuck
a pine splinter In his foot, lies In a
critical condition with lock-jaw. At

Chicago. Oct. 16.—One man was
killed nnd several other persons were
seriously Injured early today when n
passenger train on the C. and E. 1.
struck a defective rail and left the
track near Crete, 111., 10 miles south
of Chicago.
The train consisted of on engine and
eight coaches and was moving at O' 0
rate of 40 mllea an hour when the ac
cident occurred. The coaches were
filled with passengers, who were
thrown to the floor and cut and bruised
John Wlckley, engineer, was crushed
to death under the engine.
