TO TAKE TURNER'S
PLACE ON BOARD
D. Turner has tendered his resignation
as a member of the bonrd of water commis
sioners.
Daniel 8. Walraven. a conductor of tho
Southern railway, Is prominently mentioned
to succeed Mr. Turner, and It Is generally
understood that he will be elected.
Mr. Turner Is the commissioner from the
Fifth ward. Hln terra does not expire until
♦he third Mouduy In December, 1908, and
he had therefore n full year to serve. Ills

The resignation was handed to the city
clerk Monday morning. Mr. Turner states

The South Carolina Society, at Its
smoker Monday night, adopted res
olutions of regret at the Illness of
Judge Logan E. Bleckley, who is one of
the incst distinguished sons of the Pal
metto State. The resolutions, which
were telephoned to the home of Judge
Bleckley, were drawn by Colonel tlen-
ry D. Capers, as follows:
"Resolved, That the South Carolina
Society has received with sincere sor
row Information of the critical Illness
of Hon. Logan E. Bleckley, a member
of lids Society.
"Resolved, That our sincere sympa
thy be extended to our distinguished
friend, who as an eminent Jurist bus
given a full expression of the Ideal law
yer and Judge tho Incorruptible patriot
and model eltlxen.
"Resolved. That our secretary con
vey to Judge Bleckley these expres
sions of our regard.”

J. B. Marbury, United States "weath
er bureau man,” one ot the star wit
nesses for the defenae, went through
statistics which he hod gathered to
show just how full the moon was on
the night of the killing and how many
clouds obscured tlie sky. In msklng
his conclusions, the attorneys for tbs
defense brought him an almanac. This
almanac will probably be placed among
the evidence which will go to tho Jury
in the case.
Mr. Marbury was questioned by the
defense as to a person’s ability to Iden
tify people by moonlight.
”1 experimented with my wife on
Just that point,” said Mr. Marbury.
"The tnoon was three-quarters full
when I made the experiment. My wife
was 50. feet away and could not iden
tify tnc."
In Colonel Hill's cross-examination,
the court room was kept In a roar or
laughter.
A False Prophet.
"You prophesied, did you not." said
Colonel Hill, "that yesterday was go
ing to be n fine day? And It rained.”
Mr. Marbury detded making the
prophesy, which was published In one
of tho papers. On a question from
Colonel Hill, he admitted that his pre
dictions were not Infallible.
One of the witnesses for the defense,
A. C. Eubank, county policeman, con
tradicted part of the state's evidence I
lie said that on the night of the shoot
ing he and Policeman Heard were the
only officers close to the negroes when,
the lutter fired. The state claims a
number of officers wero there. The
rase will probably occupy all of Tues
day and Wcdnesosy.

Mrs. Jane A. Pierce died very sud
denly at the home of her daughter. Mrs.
F. II. Peck, 2$5 West Peachtree street,
Monday afternoon. Mrs. Pierce had
been an Invalid for several years, but
appeared in good health recently, and
her death came as a shock to her chil
dren and friends. She was the widow
of William B. Pierce, of Indianapolis,
and hod lived with her daughters tn
Atlanta in recent years. She Is sur
vived by tow children, Mr*. Watson
Fuller and Mr*. F. H. Peck, and six
grandson*, who will act ns the pall
bearers. Th# funeral services will be

WATCHMAN IS SHOT;
BELIEVED THE RESULT

Chattanooga. Tsnn., Doc. 11.—Mar
shall Harvey, a watchman of the Queen
and Crescent railroad, was shot ^nd
probably fatally wounded by an un
known negro In the yards of tbs rail
road here this morning.
John Smith, a negro, was arrested as
u suspect, but was released. A posse
of officers and bloodhounds are on the
trail of r negro. It Is believed friends
of Fred Cobb, who was klllsd by Hsr-
ey recently, are back of the shooting.
The coroner's Jury exonerated Har
ry. but feeling In Cobb's family run
high.

tanooga te fit. Louis arrived In Atlenta
Tuesday morning to await the arrival
of ths body of W. F. March, of Nash
ville, assistant general passenger agent,
who died Sunday In Miami, Fla., where
he had gone in search of health.
The body la expected to arrive In
this city Tuesday night or Wednesday
morning. It Is being accompanied by
Miss Willie March, daughter of Mr.
March, and Cole Danley, Florida pas
