A question of municipal ownership Is
involved in a decision handed down
Thursday hy the supreme court In the
case of'* Thomas H. Baker against the
city of Cartersville, and which upholds,
In a large measure, municipal owner
ship of Important utilities.
Dr. Baker sought to enjoin the city
of Cartersville from the Issuance of
$40,000 in bonds, which were to be
used as follows: $25,000 for building
nn electric light plant; $10,000 for im
proving the waterworks, and $5,000 for
improving the gas plant.
Dr. Baker also sought to enjoin the
city "from embarking on the enter
prise of manufacture and sale of elec
tricity and gas, either or'both." His
contention was that the city in its
printed notice of the election did not
clearly set forth to the voters the plan
to furnish electricity and gas for com
mercial purposes. /
In reply the city denied any inten
tion of entering Into "a commercial en
terprise.” and the purpose was simply
to furnish citizens electricity or gas
for homes and business houses. There
was no Intention of furnishing power
for commercial use. Judge Kite re
fused an interlocutory* Injunction, and
the petitioner excepted.
City Has the Right.
In upholding this decision the su
preme court points out that the con
trolling question is whether the city
had the right to furnish citizens lighs
in their homes and places of business.
Inasmuch as the city had been fur
nishing gas for such, purposes the in
ference must have been cledr that a
continuance of the custom would result
with added Improvements made with
the bond Issue.
The courts have held time and again
that the vending of lights nnd water to
private consumers was but an Incident
in the supply of these elements for
strictly public use aud within the con
stitutional limitations. Further, the
charter of Cartersville expressly grants
this authority to the city.
inasmuch as the city disclaims any
purpose of embarking In u commercial
enterprise, and claims only* to furnish
electricity and gus for lighting homes
and business houses, the Judge did not
err in refusing an Injunction.

Pitisliurg.' Pa., Dec. 13,—In criminal
court this afternoon Clifford Hooa, the
negro coachman who was convicted of
perjury as a result of statements be-
fore the trial of the Hartje divorce case,
was sentenced to serve six years In
Riverside pen and pay a fine of 190.
He took the sentence calmly and
wnlked out of the room with a deputy
sheriff.
The next move In the celebrated
Hartje divorce will be the preparation
of the record on the part of the mil
lionaire manufacturer for his Intended
nppeal to the superior court.

London. Dec. 13,—The Express re
vives with circumstantial details the
report that the Right Hon. James Bryce
will be appointed British ambassador
at Washington. It says the question
has practically been decided.

An ordinance will be Introduced into
council Monday making all clubs that
sell or distribute whisky or other In
toxicants pay a license of $300.
The tax comroittej decided Wednes
day to Introduce an ordinance making
It prohibitory for all desiring to estab
lish clubs In the city, to apply to the
mayor for permission, and making all
who sell or distribute drinks pay a $300
license.
The clubs, especially the richer ones,
do not object much to the paying of
the license, but they fear that some of
ficial might tftke the license as a vir
tual admission that a saloon Is being
operated at the club and thus enforce
the 10 o’clock closing hour.

doth, Aged 9 years, was shot nud Acci
dentally killed by his brother, Alexnuder,
aged 7 years. The boys were playing with
a double-barrel shotgun, supposed to be un
loaded, when the weapon was accidentally
discharged, while In the bonds of Alex
ander, lUo loud entering Jasper’s neck, al
most severing the head from the body.

navy department for America'* new
monster battleship, which were sub
mitted to congress today, call for u
main battery of ten 12-Inch guns, a
displacement of 20,000 tons, a speed of
21 knots and a length of 510 feet wa
ter line.
These plans call for a heavier dis
placement, armament and speed than
any other American warship and Is ex
pected to prove as formidable
weapon of warfare ns any battleship
afloat or under construction In any
navy of the world.

ship subsidy bill this morning. The
subcommittee held a meeting and
reached an agreement to vote Hatur-
day on the bill as It had been modi
fied by Chairman Orosvenor. After
the meeting of the committee tne Re

and Chairman Grosvenor announced
that a caucus would be held tomorrow
as the Republicans wanted to deter
