I T appearing to the Court by the petition of Henry G.
Cole that on the TTth day of Apnl, 1863, the defendant
made aad delivered (4 the plaintiff his < ri tain promissory
note of that date, whereby he promised, on or before the
1st davof January. 1865, for value received, to pay said
plaintiff, or hearer, Five Thousand Two Hundred Nine
Dollars and Six Oefoa, with interest from date, (the inter
est payable annually), and afterward*, au the mine day,
made and delivered to apm his certain deed of
mortgage conveying to said plaintiff all those tracts or
parcels of land lying in the city of Marietta, in aaid county,
namely: the house and lot on the south aide of the public
square, known aa the “Marietta Hotel,” known as lots
Noe. nine, (9), ten, (16), one hundred and sixteen, (116),
one hundred aad aeeeueen, (1 ID. Also, a email lot then
occupied by the said Hotel, and formerly known as the
‘■Barber Sot.” , ,, , .
Also, all that city lot in said city lying broadside to lot
of J. B. O’NeilL uMta E. J. Camp, and described m said
deed, bounded on the west by Powder Springs street, on
the east bv an alley running up to the livery stables, on
the north by a lot belonging to the estate of J. A. G. An
derson, and on the sonth by said Camp lot, in width
twenty-one and q half feet, and one hundred and thirty-
three feet long, more or less; and also that parcel of land
and house in said city folly described by E. J Camp’s deed
to said H. G. Cole, and formerly occupied by A. W. York,
containing one-fourth of an acre, more or less. And it ap
pearing that said note is wholly unpaid—
Therefore, ordered, that the said D. J. Dismnkes do pay
into thi# Court, on or before the first day of the next
term thereof, the principal and interest due on said note,
and the costs of this proceeding, or show cause to the
contrary, if any he can, and that on foil are so to do, the
equity of redemption in and to said mortgaged premises
be forever thereof barred and foreclosed.
And it is farther ordered that this role be published in
the Atlanta InUUlgehcer once a month for four months
previous to the next term of this Court, or served person
ally on the defendant, or his special agent or attorney, at
least three months previous to the next term of uiib
