that, on the 24th day of November, 1860, the defendant
made and delivered to the plaintiff his promissory- note,
bearing date the day and year aforesaid, whereby the de
fendant promised, on or before the 25th day of December
next following the date of said note, to pay the plaintiff,
or bearer, thirty dollars for value received; and that after
wards, to-wit: on the day aud year aforesaid, the defend
ant, the better to secure the payment of said note, exe
cuted and delivered to the plaintiff his deed of mortgage,
whereby- said defendant mortgaged to the plaintiff lot of
land No. 670, in the third district of said county, contain
ing forty acres, more or less. And it further appearing
that said note remains unpaid: It is therefore ordered,
That said defendant do pay into this court, on or before
the first of the next term thereof, the principal, interest
and costs due on said note, or show canse to the contrary,
if any- he can ; and on failure of the defendant to do so,
the equity of redemption in and to said mortgaged pre
mises be forever thereafter barred and foreclosed. And
it is further ordered. That this rule be published in the
Atlanta Intelligencer once a month for four months pre
vions to the next term of this court, or served on the de

selves together as a body corporate, under tlie name aud
style of the “Fulton Petroleum A Mining Company,”
for the purpose of boriug for petroleum or coal oil, and
mining for minerals, preparing the same for market and
vending the same at points and places most conducive
to the interests of all concerned, do herein aud hereby

I. That your applicants be associated and incorporated
together under the corporate name and style of the --Kill-
ton Petroleum and Mining. Company,” with all the pow
ers. privileges, rights and immunities by the code and
laws of tlie State of Georgia in such cases made and pro
vided.
II. That the objects of this corporation or association
will be the boring for petroleum or coal oil, aud mining
for minerals in the States of Georgia, Alabama and Ten
nessee, and elsewhere, as the geological features of the
country may indicate as most conducive to success ; the
preparation of said petroleum or coal oil and minerals,
when found, for market, and the vending of the same iu
suitable markets.
III. That the period for which these applicants desire
the benefit of incorporation in the manner and for the
purpose within specified, is twenty years.
IV. That the capital stock of this Company shall con
sist ot four thousand shares, with the privilege of in
creasing the same to ten thousand shares, ot the par
value of fifty dollurs per share ; that the same Is, and
shall be represented by actual property, by leaseH upon
petroleum and mineral lands in the States of Georgiu,
Alabama, Tennessee aud elsewhere, situate and being
known and designated as per lease held and to be ob
tained by said Company.
V. The capital actually paid in shall be not less than
twenty thousand dollars, before commencement of opera
tions, which said sum shall be raised bv the sale or trans
fer of the stock over and above that taken by the under
signed ; and should it become necessary to increase said
sum, future assessments of stock shall only be made by
a majority vote of the shares held by the stockholders.
VI. That full power and authority be granted to these
applicants for vuluable consideration, to sell aud assign
to any third party or parties, pharos of stock or certifi
cates of interest in the said Company.
VII. That the said applicants shall have power at any
time to meet and elect a President, General Superinten
dent, Secretary, Treasurer, and such other officers and
agents as they may deem necessary to the organization
and successful working of said Company ; aud that any
vacancy occurring thereafter in any such offices and agen
cies, shall be filled according to tlie by-laws aud rules
which may be adopted.
VIII. That the place of general bnsiness and the loca
tion of the said Incorporation shall be at Atlanta, Fulton
county, in the State of Georgia.

lanta. in said county, to Shadrick I. McMicbael, and that
said original Deed is lost or destroyed; said petition and
a copy iu substance of said Deed, duly sworu to, being
on file in said office.
You are, therefore, hereby called on to show canse, if
any yon have, at the October Term, 1866, of said Court,
Why said copy of Deed shonld not be established, in lieu
of the original Deed so lost or destroyed.
