I T appearing to the Court by the petition of Ezzard,
and Hulsey and Daniel Pittman, that on the 20th
day of November, in the year of our Lord eighteen hun
dred and sixty-five, William F. IlerringtOD. of said conn
ty, made and delivered to petitioners, his promissory
note for seventy-five dollars, and that afterwards, on the
same day to secure the payment of said instrument, exe
cuted and delivered to said petitioners his Deed of Mort
gage, whereby he conveyed to them (petitioners) a part
ol'iaud lot fifty-six, in the sixth district of Gwinnett
county, it being one hundred and fifty acres ot the north
ern part of said lot, conditioned that if said Wm. F. Her
rington should pay off and discharge said promissory
Dote according to iis tenorand effect, that then saidDeed
ot Mortgage aDd said note should be void. And it further
appearing that said promissory note remains unpaid, it
is therefore ordered that Wm. F. Herrington pay into
this Court by the first day of next term thereof, the prin
cipal, interest and cost due on said promissory note, or
show cause to the contrary if there be any; and that on
failure of said Wm. F. Herringtou so to do, the equity of
redemption in and to said Mortgaged premises be lorever
thereafter barred and foreclosed.
And it is fnrlher ordered that this Rule be published in
the Atlanta Intelligencer once a month for four months
or a copy thereof served on the said Wm. F. Herrington,

before the the next term of this Court.
