it: relation to an important decision made by the
High Court of Errors and Appeals,ol Mississippi
The following is more at length, and essential to
a proper untierstanding of the decision. It was
contended that the entire legislation of the State
attempting to suspend the statute ol limitations
was void:
It is said that in order to pass valid laws, the
legislature must Ik- a valid and legal body, and
must assemble and act under, and in harmony
with, the paramount laws of the laud; that be
fore the passage of the act attempting to suspend
the statute of limitations in (January, 1861,) Mis
sissippi, by an ordinance ol her Convention, at
tempted to withdraw from the Union, and short
ly thereafter became one of the “Confederate
States”—an enemy in hostility to the United
States ; that by unsuccessful revolution “she Is
remitted bar k to her status ante beUuvi all acts
done by her during the war being nullthat
failing to create a new government de jure, and
having no government de facto established and
recognized, she must be considered as having all
along constituted one of the United Slate.--, not
withstanding her ordinance of secession; (Latin
addition to this, by her ordinance of August,
186,1, the Convention of Mississippi declared the
ordinance of secession null and void.
It is insisted that the State of Mississippi has
never been able to legislate lawfully and consti
tutionally, “except as one of the United States
that by the Constitution ot the United Suites, as
well as the Constitution of this State, the mem
bers of the Legislature were Ixmnd to take an
oath to support the Constitution of the United
States, and that, by the State Constitution, “be
fore” they entered upon the duties, they were
bound to swear to support both Constitutions;
that the Convention of 1861, by the ordinance of
secession, abrogated this oath, and substituted a
hostile one; and hence it is argued that the Le
gislature, after that ordinance, organizing in
“ hostility to the organic law,” could puss no
valiJ act; that Mississippi did not cease to be a
sovereign State, as she had always been, “'as on-
of 1 fie United States,” in spite of her ordinance
of secession. In that character only could she
legislate lawfully, when acting in conformity
with, and in subordination to, the Constitution”;
anti failing to take the oath required by both
Constitutions, and taking another and hostile
oath substituted for it, her Legislature could pass
no valid act.
i. That the provisions in the Constitution of
the United States, as well as the State of Missis
sippi, requiring members of the Legislature to
lake an oath to support the Constitution of the
United Slates, is merely directory, and the fail
ure to take such oatli will not invalidate their
action.
•J. That all acts passed by the Legislature of
Mississippi during the war, not inconsistent with
her organic law, were valid, and remained so af
terwards, until altered or repealed by her author
ity, with the exception that, upon the return of
peace, all such acts as were inconsistent with the
Constitution of tltfe United States, or the laws
passed in pursuance thereof, and then existing,
were thereby annulled.

A Suggestion.—We find the paragraph be
low, in the Chattanooga Union, of the 2."ilt :
While Chattanooga is doing so much to relieve
the starving poor in its midst, we would suggest
to the Georgia State authorities that they could
do considerable by oll'ering to transport many of
them who have friends, and who came originally
from Georgia, to their old homes, instead ol in
sisting on being paid full fare and making our
cliailiable citizens loot the whole expense.

I T appearing to the Court by the petition of Ezznrd,
and Hulsey and Daniel Pittman, that on the 20th
day of November, in the year of our Lord eighteen hun
dred and sixty-five, William F. Herrington, of said coun
ty, made and delivered to petitioners, his promissory
note for seventy-five dollars, and that afterwards, ou the
same day to secure the payment of said instrument, exe
cuted and delivered to said petitioners his Deed of Mort
gage, whereby he conveyed to them (petitioners) a part,
ofiand lot fifty-six, in the sixth district of Gwinnett
county, it being one hundred and fifty acres ot the north
ern part of said lot, conditioned that if said Wm. F. Her
rington should pay off and discharge said promissory
note according to its tenor anil effect, that then said Deed
of Mortgage and said note should be void. Aud it further
appearing that said promissory note remains unpaid, it
is therefore ordered that Wm. F. Herrington pay into
this Court by the first day of next term thereof, the prin
cipal, interest and cost due on said promissory note, or
show cause to the contrary if there lie any; and that on
failure of eaid Wm. F. Herrington so to do, the equity of
redemption in and to said Mortgaged premises be forever
thereafter barred and foreclosed.
And it is further ordered that this Rule be published in
the Atlanta Intelligencer once a month for four months
or a copy thereot served on the said Wm. F. Herrington,
or his special agent or attorney, at least three months
before the the next term of this Court.
