Notice to the public is hereby given
that on February 11, 2009, at 9:00
o’clock a.m., in the Superior Court of
Jenkins County at the courthouse in
said County, a hearing will be held in
the case of State of Georgia v. City of
Millen, on the petition to validate the
City of Millen Water and Sewer Reve
nue Bond, Series 2009, in the principal
amount of $805,000, authorized to be
issued pursuant to Bond Resolution
adopted on January 6,2009, by votes of
a majority of the members of the gov
erning body of the City of Millen, and
that at said hearing all persons having a
right to be heard with respect to said
bond and the security provided therefor
by said Bond Resolution and with re
spect to the validation thereof may be

kins County records in Deed Book AP@
as pages 243-44; Quitclaim Deed from

Brown, J. Roscoe Brown and W. Roun
tree Brown to S. T. Brown dated No
vember 26, 1936, and recorded in Jen
kins County records in Deed Book V,
page 195; Quitclaim Deed from Olney

Brown to S. T. Brown dated September
22, 1941, and recorded in Jenkins
County records at Deed Book Z at page
595.
Said tract is further identified as Parcel
154 on Map M09 located in the office of
th Tax Assessor of Jenkins County,
Georgia.
The debt evidenced by said Note
and secured by said Deed To Secure
Debt has been and is declared due and
payable in full because of the Debtor’s
failure to comply with certain provisions
of the Note and Deed To Secure Debt.
Notice has been given of intention to
enforce provisions for collection of at
torney’s fees and foreclosure in accord
ance with legal requirements in the
terms of the Deed To Secure Debt and
Note. The indebtedness remaining in
default, the sale will be made for the
purpose of applying proceeds thereof to
the payment of the indebtedness se
cured by the Deed To Secure Debt, ac
crued interest, and expenses of the sale
and other sums secured by the Deed To
Secure Debt, including attorney’s fees,

Under and by virtue of the power of sale
in that certain deed to secure debt from
William Wadley as grantor, to Millen
Loan and Finance Corporation, as
grantee, dated January 9, 2004 record
ed in Deed Book 5-F Folio 120 which
deed to secure debt secures a note dat
ed January 9, 2004 in the original prin
cipal sum of $1,140.00 there will be sold
by the undersigned at public outcry, dur
ing the legal hours of sale, before the
door of the courthouse in Jenkins
County, Georgia, on the first Tuesday of
March 2009 to the highest bidder for
cash, the following described real prop

ant to the terms of said deed to secure
