Ja sheweth that, heretofore, to-wit: on the 16th
clay of April, iti the year of our Lord eighteen hun
dred and fifty-five Austin Smith, of said couuty,
mnde and delivered to your petitioner his certain
instrument in writing, call and a promisory note,
whereby he promised ‘Oil or before the seventeeuth
day of April, eighteen hundred and fifty five, next
following the date of said note, to pay to yopr peti
tioner, or bearer, eleven hundred and sixty-three
dollars and fist rents for value received ; and for the
better securing the payment of the said note on . the
day and year aforesaid, said Austiu Smith executed
and delivered toyoar petitioner his certain deed of
mortgage conveying to your petitioner lots of land
number (188)one hundred and ninety-three; and
number (163) one hundred and three, (i xcept so
much of the last named lot as lies on the west sidl
ed Coxes creek, said reserve being thirty acres more
or less,) in the eighth district of said county—
condition to be void on the payment of the prouiiso
ry note aforesaid —which promisory note and deed
of mortgage are here in Court to be shown. Yet,
your petitioner avers that said Austin Smith, al
though so iudebted, and to pay said promisory note
often requested, hath not paid said n. to or auy part
thereof; but the same to pay hath hitherto and vet

IT appeal ing to the Court by the petition of Tim
otn Kirkland, that on the sixteenth day of April,
in the year of our Lord eighteen hundred and liffy
-five, Austin Smith, of said county, made and deliv
ered to said Timothy Kirkland his certain promisory
note, bearißg date the day and year aforesaid,
w hereby, the said Austin Smith promised on or be
fore the seventeenth day of April, next following
the date of said note, to pay said Timothy Kirkland,
or bearer, eleven hundred Slid sixty-three dollars and
sixty-two cents for value received; and that after,
wards pn the same day aud year aforesaid, the said
Austin Smith the better to secure The paymeut of
said note, executed and delivered to said Timothy
Kirkland his deed of mortgage, whereby, the said
Austiu Smith convoyed to tho said Timothy Kiik
land, lots of land number (103) one hundred and
ninety-thlreo. and number (103) one hundred and
three, in the eighteenth district of Raid county;
oaenof said lots containing four hundred and ninety
acres more or less, except so innch of lot number
one hundred atid three as lies ou the west side of
Coxes Creek, cnutaiuing thirty acres more or less,
conditioned that if the said Austin Smith should pay
off and discharge said note or cause it to be done
according to the tenor and effect thereof, that then
the said deed of mortgage and the said note should
become, and be null and void to all intents snd
purposes; and it further appearing that said note
remains unpaid, it is, therefore, on motion of John
0. Nicbolls, Pl’ffs Att’y, ordered that the said Aus
tin Smith do pay into court by the first day of the
next term thereof, the principle, interest, and cost,
due on said note, (or show cause to the contrary, \(
any ho has) and that on the failure of the said Aus
tin Smith so to do, the equity of redemption in aad
to said mortgage premises, be forever thereafter
barred and foreclosed. And it is further ordered
that this rule be published in the Wire-Grass Expor
ter once a month for four months, or a copy thereof
served ou the said Austin Smith, or his special agent
nr attorney, at least three mouths previous to tho

Samuel A. Austin, late of aaid county deceased
respectfully sheweth, that as Administrator as afore
said, he has fully discharged all the duties required
by the laws of said State—that he has made a final
settlement of said estate by paying over the lull
amount of property, money, and effects in hand, be
longing to the same, to the legal distributees of said
estate. He therefore petitions to be dismissed from
said Administration.
