By Bennett Says She Did Not
Gossip About Him.

street, characterized by H. F. Bennett
in the death notes as the person whj
I caused the tragedy by her 'lies, em
phatically denied to a Journal reporter
Friday afternoon that she *ver gossip
ed about the affairs of the Bennetts.
"I only hope Bennett prayed before
h,. wrote that lie," Mrs Rutledge said,

Mr*. Rutledge, who is ft widow,

"When the work was finished he.
told me that he had separated from
his wife, and that he wanted me to
take care of the baby, I-aura.

rated eight times from his wife and
that three times he had taken the baby
out of the Home for the Friendless for
the periods that they lived together.
Recalls'- he moved the habv so much
the home had refused to take it this
time, he told me.
"He said he would pay for the baby’s
keep, and so I took It. He brought
the child out here one Tuesday, about
two weeks ago, and It remained until
Saturday.
"Then Bennett's wife came out here
with a note from him telling me to
let her have the baby. I gave the
child to her, and soon she left
"She and Bennett earn, baek one day
after that, and it was the last time 1
ever saw either of them.”
Mrs. Rutledge admits that on the
occasion of the last visit that she and
the Bennetts had talked sharply to
each other, and she admits giving them
a little "advice,” hut that ts all she
Is willing to gay.- Atlanta Journal.

a negro, killed eight other negroes
here today with a short handled axe
because ho suspected they had charged
him with horse theft. Twice this Week
when arrested at small towns near
here on the charge. Mannings broke
Jail Ho arrived here today before
daylight. After the killing he was
arrested but escaped from a train en
route to Jail. Possos are searching
for him.

upon legislation by the federal consti
tution have been reperalc-d by the su
prems court and the nations laws
now are enacted and enforced as the
people demand without regard to any
previously established limitations,
United States Senator James Hamil
ton Lewis, of Illinois, declared In an
address before the Maryland Bar As
sociation here today.
Senator Lewis' subject was "Law
and Government.”
By General Consent.
“In this United States there is no
law of government,” declared the
speaker. Our nation now is guided
by a general consent to yield to what
the people demand from government,
without regard to any laws existing
for the control of government. We
have no constitution that Is of any
effect as limitation on legislation
nor as a source of authority to offic
ials. The lormer line of division be
tween states and nation is effaced — j
over this former space extends the!
merger of state with nation —with
the state absorbed in the nation. The
former limits of the rights of states;
and the power of tne United States,
are all wiped out.
In Every Part.
' The supreme court ot the United
States by decisions has repealed the
constitution of the United States in;
every part that had previously serv-1
ed to place limits oil congressional
legislation or that which authorized,
by recognition the sovereign power of |
states for self government. We have
no chart to guide legislation—no fun
damental law to restrain impulsive;
enactments.
Charter of Confusion.
The constitution of the United j
States—as construe I by the courts—
has become a charter of confusion
and a contract of obstruction to pop
ular government by popular will.
The courts now concede that the peo
pie will have their laws as they will,
and judges assent that to declare
such laws unconstitutional would but
arouse resentment against the courts
and insurrection against he decisions.
We have a president whose public
acts show him to be an advocate of
remedies and reliefs consistent with
the institutions of a free republic,,
rather than consistent with a consti
tution that shackles the republic. j
The New Truth.
“We must now recognize the new
truth borne In on ua. \V'e must have
a new constitution U'amed in the new
order, expressing the new govern
mental powers the people have taken
to themselves. We have i-assed from
a republican representative govern
ment to a democracy of direct execu
tion of popular will and personal de
sire. Confiscation of corporate prop
erty under the decree oT peoples
need and government necessity, is
dally licensed by legislation, while
the individual is authorized to put the
personal need of himself.as he de
cides it. over public welfare as prev
iously decreed by law.
“The new times demand a consti- I
tution fitting to the new needs of a
new generation, or the abolishment
of the constitution and the substitu
tion of the personal judgment of the
individual citizen as to where rights
begin and wrongs should 6 end."

in Chicago arid the surrounding states
has become centralized in the hands
of half a dozen men. according to a
report made public today by Mr. Fer
ry, Chicago’s chairman of public ser
vice Mr. Kerry urged further invest,-
tigation to determine whether the city
■suffered by reason of the centralized
control.
Named in particular in the report
are Samuel Insult. John J. Mitchell
James A. Fatten, Henry A. Blair and
Ira M. Cube who, said Mr. Ferry, ex
ercise control over the Commonwealth
Edison Company, which supplies elec,
trie power and light; the People's Gas
Light and < 'oke Company; the Chi
cago Elevated Railways; the Chicago
Surface Lines, and numerous utility
companies in surrounding towns
"No facts are in the possession of
the department of public serviaej’
said Mr. Ferry, "which would jus
tify the statement that the prices paid
for current by the -several transpor
tation companies is excessive, but the
circumstances under which these con
tracts were made with subtsantlally
the same men as buyers and sellers
suggest inquiry.”
