—The trial of Mis. Cordelia Bot
kin, who is suspect'd of the
murders of Mrs. Dunning and
Mrs Deane, of Dover, Del., by
sending them, poisoned candy,
may not Le proceeded with as
much expedition as the prose
cution of the Delaware witness
es were led to believe.
When the prosecution condo
led its opening statemint to
the jury on Wednesday the case
was scheduled to begin today.
S.-.turday afternoon, in the
Supreme Cour', there was filed
a petition a-king that Superior
Court Judge Car oil Cook be
enj med from proce-ding with
the Botkin trial.
ihe petitioner is Louis P.
Boardman, who was one of Dur
rant’s attorneys, acting as the
attorney of W. L. harper, a
taxpayer. The petition to the
Supreme court was filed after
con ; illting with tin treusurer—

Francesco T'iie petit', n alleges

tha the city will be put to use
less expense.
It is now recalled that during
the empanelling of the jury the
attorneys for the defense were
rather indifferent as to the jury,
and they did not seem to be dis
turbed when the prosecuting
attorney made his opening ad
dress. All along they nave en
couraged their client, and told
newspapermen that Mrs. Botkin
would never be convicted of
murder in this stale.
The petitioner in the supreme
court case today avers that it is
the purpose of the defense to
allow the prosecution to spend a
lot of time and the city s money
in introducing the evidence and
then contend that the state has
no jurisdiction.
The supreme court h s already
decided that Mrs. Botkin could
n >t be extradited on a charge oi
murder The petitioner intimates
that the money already expend
ed for the transportation and
care of the Delaware witnesses
(about $3000) was illegally
spent.
