Judge Estill lastnight decided the
habeas corpus case of certain
young men sent to jail by Justice
of the Peace M . M . Hope, for re
fus' to answer certain questions
as to whether they saw parties
gambling in the city. He ruled
that the justice had no right to ask
such a question and the young
n«n were released.
They stated on the trial before
the justice that they believed that
to answer th® question?propuuded
by the prosecution would incri
mate themselves .
The matter has increated ex
citement, both among the law
abiding people as well as the mi
biers, who are greatly tickled last
night over 'be turn the affair has

The decision makes conviction
before a jus l ic of peace in gamb
ling cases practically imposaib'e

court of errors and appeals met
today and r> mb led a number of
decisions. W illiam H. Eriuden
burgh the newlv Judge
of the court, was present and was
sworn in by the chancellor.
One of the opinions rendered is
of S 1 neral importance to beneficial
t rganizations. The court affirmed
the supreme court in the case ol
the R.xbury lodge, Independent
Order of Odd Fellows, agait st
Wi’liam Hocking. When Hocking
joined the Roxbury lodge the sick
benefits were $3 a we -k for an
ind-finite peri-d. Subsequently
they were changed to $5 a week
for twenty six weeks and $1 a week
thereafter. Hocking was sick for
a long time :nd son’h u> rocovei

Hugo Stubenvoll. pastor of the

his home in Geneva street tonight,

Rev, Mr. Stubenvoll recently
had some trouble with boys win,
were persistenteutly disturbing
the services at the churc.h A con
cert was held at the church Sat
urday night and the old Double
was renewed, so the police weie
notified and the disturbers fl -d.
Sometime after the concert Rev,
Stnbenvcl’ left his house, which
ad joins the church, and proceeded
to an outbuilding in the rear of
his home. Returning, he was at
tacked bv a masked mam of med
ium height, who thrust the blade
of a knife into his abdomen and
fled.
