Judge Spencer 11. Atkinson, who

I Georgia stste rai'road commission.
' The appointment of Col. Lewis
has not yet lieen announced by
the governor, but will be formally
announced this morning. Govern-
J or Atkinson unb long contemplat
ed the appointment of Mr. Lewis
to this place in the event that
Judge Satnpe Harns declined to
accept the appointment. Judge
Harrik yestenay informed the
governor that In could not

once determined iu appoint Mr.
Hal Lewis.
Col. Lewis was not informed of
hie appointment until late yester
day afternoon, about 7 30 o’clock.
He at once decided to accept the
place, and whem the formal ten

Surprise hardly expresses the
feeling of the politicians when it
was noised around the Kimball

Lewis had been chosen to the
high honors of the supreme bench.
They all Yec< gnized Mr. Lewis’s
great ability, but they had not ex
pected such a turn of the political
wheel. Mr. Lewis was himself
surprised. He had no idea until
after supper he was.to be appoint
ed. He was at the Kimball when
he was called over the phone by
Governor A’kinaon who told him
that he intended to make the ap
pointment this morning. Mr.
Lewis thanked the governor and
intimated that he would accept
the piece.
When Governor Atkinaon was
seen about the appointment, he
said:
“Yes, I will appoint Mr. Lewis
to the supreme bench thia morn
ing. I did not decide upon his ap
pointment until a I»t« hour to
night, although I Bad considered
hi» appointmen’f for quite a while.
You know I ati first appointed
Judge Harns to succeed Judge
1 Atkinaon. but he did not accept.
I was waiting on him until tonight.
Tonight after supper he called me
up ana told me that he had in
tended to wait until tomorrow
and see roe to tell me that he
could not accept the judgeship,
but that on account of his broth
er’s death in Athena he had decid
ed to call me up tofiight ai d de

mediately called up Mr. Lewie and
told him that I would appoint him
tomorrow morning.
“Mr. Lewis will go on the bench
about December Isf Judge At
kinson’s resignation goes into ef
fect on that date, and he will va
cate; for Mr. Lewie at once. Mr.
Lewis is. I consider, one of the
greatest jurists in the country, and
I don’t believe I could have made
t wiser selection.”
The many friends of the newly
chosen judge were congratulating
him last uight at the Kimba'l.
Mr. Lewis took the appointment
in that quiet, even way of his. and
expressed pleasure that the gov

an honorable position. He said
