UPON the petition of James Ramsey, stating
that Abner E. Holliday, deceased, late of
Su.ke countv, on the seventh day of September,
ISI4 in the county of Hurray .did make and execute
his certain bond, a copy of which is tiled In the
clerk’s odice of this court, whereby he bound him
self his heirs, executors and administrators, to
make a fee simple title to the said J“mcs Ramsey,
to a certain lot of land, being part of lot No. 2» >,
third section, ninth district,original Cherokee coun
ty drawn by Elizabeth Clark of AfcTntosli county,
beginning on the western main street, fronting on
said street 110 feet ar d running back to the alley,
and a so stating that the said Abner K. has depart
ed this life withont executing said title, and play
ing this court to direct Matthew Jones, the adimius
t ator of the -mods and chatties, lands and tenements
that were of the said Abner E., to make said title
in terms of the statute in such cases made and pro
vided —It is therefore on motion of counsel ordered,
that all persons concerned he and appear at the next
May term of this court, and then and there ahow
cause why the prayer of the petitioner shall not lie
granted. And it in further ordered that a copy of
this rule he published once a month before said
court, In one of the Gazettes of the city ot Augus
ta for three months.
