VAGRANCY LAW NOT VALID.
Avery interesting case has arisen
in California over the constitutionality
of the vagrancy law. Tne law states
that -every person who roams about
from place to place without any law
ful business is guilty of being a vag
rant and is, therefore, punishable for
'a misdemeanor. The California judge
field that this was in conflict with ar
t’cle 1, section 1, of the constitution,
which declares that all men are by
nature free and independent and have
certain inalienable rights, among
which arc those of enjoying and de
fending life and liberty, acquiring a.id
posesssing and protecting prop.- %y,
and pursuing and enjoying society and
happiness.
The court holds that if roaming
about from place to place without a.;y
lawful business were a crime any
man, no matter how wealthy, travel
ing about the country, seeking health
or pleasure, without any lawful bus
iness, would be guilty of committing
a crime, and under the definition of
the offense, guilty of being a crim
inal.
AN EXPERIMENT STATION.
A dispatch yesterday from Wash
ington says:
“South Georgia may soon secure
a government experiment station for
syrup manufacture. Representatives
in congress from that section are at
work on the project now, and they are
confident of a $20,000 appropriation
for the purpose."
Representatives Brantley, Lewis
and Griggs Have already appeared lie
fore tne agricultural committee of the
house to urge a report recommend
ing tne appropriation.
Their arguments were based on
the growth of the syrup industry in
Georgia, the largo number of people
engaged in the various branches of
the Industry, and the great advant
ages an experiment station would give

If the matter were driven to a test
we fear that that Brooklyn doctor who
offers to submit himself to vivisection
for the good of science would decide
to withdraw in favor of his wife’s rel
atives.
The Tampa Times correctly says:
While it is no business of ours, yet
we wish to make a prediction on the
outcome of the gubernatorial cam
paign in Georgia. The next governor
of the state will be either a north
Georgia or a south Georgia man. No
charge for this.
Dun's review shows that breadstuff*,
meats and garden produets cost more
today than ever before in the history
of the country. Clothing and metals
are also quoted at the highest price
save in January 1, 1901, when they
were a small fraction higher. The
total cost of living was 6 per cent,
greater in 1900 than in 1890, and 10
per cent, greater than in ttie panic
year of 1893.
Lieutenant W. 11. Whittlesey, aid to
Admiral Crowninshield, chief of the
bureau of navigation, was the author
of the despatch which ordered Dewey
to Manila, although Secretary Long
received the credit for it. Wheeler also
won Shatter’s victory at Santiago.
Schley won Sampson's victory at San
tiago over Orvera and now we hear
that Lieutenant Taylor, instead of
Funston. was responible for the cap
ture of Aguinaldo. Such is greatness
in nine cases out of ten.
WATTERSON ON SCHLEY
The following ringing editorial is
copied from the Louisville Courier-
Journal:
"And Schley ! Why, here he is I
What is the matter with you? What
are you making al! this fuss about! It
is a ground-swell, is it not? Ground
swell! it is an earthquake! And what
does it mean—what is its signifi
cance? Simplythis, that ho was there,
that he won the fight and that the
other man was not and did not. So
much to begin with. Next, if a single
Spanish ship had gotten away, Schley
would have been court martialed.
Not one got away. Next, since oth
ers have the prize money. Schley is
entitled to the glory. And, finally
and more than all, there has seemed
a conspiracy somewhere to cheat him
even out of the glory. Public opinion
simply rears back on its hind legs
and rvsents this. The sentiment of
outrage, is simply aggravated by the
circumstances that a male strumpet
carried on the pay roils of the navy
department, supported by a great but
degenerate publishing house, and ap
parently approved by persons in au
thority was permitted to blackguard
this noble officer and gentleman with
out a word of relnike during the entire
period of inquisition to which he was
subjected * * * Open the doors
