Oglethorpe, anil by that name and l\le
shall lyave perpetual succession, shall
have a common seal ami be capable in
Law and equity to purchase, havt, bold,
receive, enjoy, p.visess and retain to them
and their successors lor the use of the
City of Oglethorpe any estate or estates
real or personal of whatsoever kind or
u.store, within the Jurisdictional limits
of the City of Oglethorpe, and shall by
.the said name be capable of suing anil

Sic. 4ih. Ami lie it further enacted by
lie authority aforesaid, that all Male

demanded by the authority of the Ci y

and no other person shall he qualified to

Sec. sth. lie it further enacted by
the authoiity aforesaid—that said elec
tion shall he held tinder the Siiperinten

Iree holders, or of three freeholders, who
shall he appointed liy the City Council,
anti each of the said freeholders before
entering upon Ins duties shall take an

vent all illegal voting to the best of his;
skill and power, and in case the said man
agers of said Election shall have any

Sec • Gill, lie it further enacted by

Sec. 7th. Be it further enabled by the
authority aforesiid that in case any vacan
cy am mg the members ol the Council ei
ther by death, resignation, failme to elect,
removal from Ollier, or removal from the
City, the Mayor shall advertise anew
election to fill the said vacancy and in
case of jlte death of the Mayor his resig
nation, removal Irotn Office, or his re
moval from the City, the City Council
shall order ail election for filling the va
cancy in each case, giving ten day s nofice
in the Public Gazette of the City.

Sec. I2ili. And he it further enacted
by the authority aforesaid, that the May

tax on all free white persons within the
city of Oglethoepe between the ages of,
twenty-one and bxty years, upon all;

slaves owned or hired within the city ol
Oglethorpe, they shall also, have power
to levy and collect ala) upon all and I
every species of properly real or person
al within the limits of the City of Ogle
thorpe, upon banking or Insurance Cap

Insurance agents, and professional met)
upon factors, brokers and vendors of
Lottery tickets; thus to raise such sum
or sums of money as may be necessary
for the support and good government of
the city iii all its internal regulations nip!

Provided that the tax levied upon real
estate and stuck in trade shall not exceed

Sec. 14'lt. Be it further enacted by
the authority aforesaid, that the Mayor
and Council of the city of Oglethorpe
shad have power and authority to levy
in addition to the oilier lazes a taz of
not exceeding three dollais upon each
and every white person, nd slave in the
City of Oglethorpe between the ages of
twenty-one and forty five years as a
street tax, providid that the person s>>
taxed may relieve himself of said tax by
working on the streets for six days un
der the direction and control us the Mar
shal of the city.
See. 15. Be it further enacted by the
anthniiiy aforesaid, that the said Mayor
and Council of the City of Oglethorpe
‘shall have full power and authority to
remove or cause tube removed any build
ing, posts, steps, fenceor oilier obstruc-
■ lion or nuisance in the public streets,
i lams, alleys, side walks or public squares
j in said city, they shall further have pow
-1 er to estahli'li a market or markets in the

dinances as may he proper and necess
ary for the regulation of the same, they
shall have power to regulate all butcher
pens and Slaughter houses within the
city to remove the same if they shall be
come nuisances or injurious to the health
of the city, they .shall have power to
license, regulate and control all taverns
i and public houses within the city, they
shall have power to license Drays and

See. 26tIi. Be it further enacted that
tie said Mayor and Council of the CitV
of Oglethorpe shall liave power upon

within die city to cause the occupants
thereof to lie forcibly removed without,
tbe city if they ‘hall refuse to leave the ,
city after£ir days notice.
Sec, 17th. Be it further enacted by;
the authority aforesaid that the said May,
or and Council of the City of Ogletboi pe |
shall have power to license and appoint
annoaily as in my auctioneers or ven
due masters for the city as they mav
deem proper, and to receive from each
one the sum ol fifty dollars as fixed hv
law; and they shall further have power
to levy a tax upon all goods sold at auc
lion in said city to be paid bv die auction
eer.
See. 18th. JJe jt further euacU‘d by tbe
authority aforesaid, that the said May

shall have the Side and exclusive right
of granting license to retail liquor in the
City nl Oglethorpe and fixing’ tlie rates
of such license and the terms upon which
they shall issue,, of declaring said license
void when s#id are not complied
with, they shall also have power to licen- :
se, regulate and contiol all ten pin alleys
within the city ami to remove tlie same
w hen they become nuisances to die neigh- j
borhood.
See. 19th. Be it further enacted, that
the said Mayor and Council of the City
ol Oglethorpe shall have power to tax all
theatiica! performances and exhibitions
or shows of any kind within tlie corpor
ate limits of said City.
See. 20th. Be it further enacted by
! the authority aforesaid, that tbe said
Mayor and Council of the City of Ogle
| tborpe shall have power to pass all ori
j dinances, rules, and regulations, necess,
ary and proper for tiie government anil
subjection of all slaves and free persons
of color w ithin the city, and the Marshals
and such other persons as the Mav or and
Council shall appoint, are hereby vested J
w ith the full power and authority of pal
role in said City.
Sec. 21st. Beit further enacted by t|ie
authority aforesaid, that the said Mayor
and Council of die City of Oglethorpe
shall have the power to remove any forge
or Smith Shop wlien, io their opinion it
shall he necessary, to insure safely a
gainst fire, they shall have power to

to fire, to he removed or remedied as their
prudence shall dictate.
Sec. 22d. Be it further enurjed, that
the said M *ynr and Council ol the City
ol Oglethorpe shall, during the month of
yjpril in each year appoint seven fit an I
proper persons who shall constitute the
boatl of Health of said - Citv. It shad
be die duty of stjid hoard of Health, four
of whom shall constitute a quorum to
meet weekly or as often as may he ne
cessary to visit all and every pan of the
citv, and to report to lire Council all nu
isance w hich are likely to endanger the
health of the city or of any neighborhood
and the said Mayor and (Council shall
have power upon the report of the board
of Health to i an-e any such guidance to
he abated and their reconnoeodatiots
carried oui in a summary maouer at the
expense of the party whose act or negli
gence caused sugh nuisance pr the onwer
oflhe premises as the Council may elect.
S*C. 23d. Be it further enacted by the
authority aloresaid, that die said Mayor
and Council of die City of Oglethorpe
upon the recommendation of the Boad of
Health, shall have power and authority,
to cause die owners ol lnts wiiliin the said
citv to dr.iiuliie same, or to fill the san e
to the level oflhe streets, or alleys oil which
said lot or lots are fronting: also to compel
the owners of cellars occasionally holding
w ater, to cause the same to be emptied of
their water, or fill up, if necessary and ip
case the owner of said lot or Ids shall fail
or refuse, after reasonable notice to liiip or
his agent to comply with die requirements
of the sjd Mayor and Council by filling
up said lots or cellars, or by draining die
same, it shall be lawful for the said Mayor
pud Council to employ some persnq tofdo
die same and, for the a mount so expended
the city Treasurer shall forthwith issue
ail execution against die owner of said
properly to he collected from said lot, or
any other property belonging to him,
and a sale under said execution hy the
Marshal shall pass the title to the prop
erty sold as completely as a sale under a
Judgement and execution of the sheriff.
See. 24ih. Be it further enacted by
the authority aforesaid that the said May
or and Council of the City of Oglethorpe
shall have power to ftll anv vacancies
which may opeur ip the Board of Health
and this act may be pleaded, and shall
be a complete defence to any action
brought against said M‘<>'or and Council
or ei)htr of them for apy art done by
them under its provisions and of (he ordi
nances passed in persuance of it.
See. 25th. Be it lurter enacted by the
authority aforesaid, that the said Mayor
and Council of die City of. Oglethorpe
shall have power to take up and impound
any Horses, Mules, Cattle or hogs run
ning at larga w ithin the limits of said
City and to pass such ordinances os may
be deemed by them necessary lor the prop
er regulation of stock within the City.
Sec. 2<dh. And be it .further enacted
by the authority aforesaid, that the said
Mayor and Council ol the City of Ogle
thorpe shall have power In establish and
, regulate a City Guards who shall have
.{he right to take op all disorderly persons
! all persons commitligg or attempting to
’ commit any crime, and to commit them

the next day, and the said guard shall
also, have the power and authority of
patroles over slaves and free persons of
color.
Sec. 27th. Be it further enacted by the
authority aforesaid that tbe said Mayor
and Aldermen of the City ol Oglethorpe,

origimial plan of said City, the

regular aieeting; and any application of
this kind shall be pubished lor one Month
before the final action of the Council
thereon.
Sec. 29th. Be ti further'enacteil by tlie
authority aforesaid; that the said Mayor
and Council of the Cily of Oglethorpe
shall have die power to appoint inspect., i
ors of the Weights and Measures in use
in said City, and to fix the fees for the
same which shall bp paid by the parties

See. 30th. Be it further enacted by

upon notice in writing from the Mayor

S*c. 31st. A nd be it further enacted
by die authority aforesaid, that the said
Mayor and Council of the City of Ogle
thorpe shall have the power, il in their
discretion they see proper, to appoint
assessors to value tile real estate of said
City for taxation, and all taxes levied by
said Mayor and council, shall be collect
ed by the Treasurer of the City and, if
after giving twenty d}S notice at the
most public place in said City ol the day
on which his hooks will be closed, there
shall he a defaulter or defaulters, the
Treasurer is hereby authorised to issue
an Execution against die property of any
pitchdefaulters, directed to the Chy Mar
tha!,w humayproceed to |eyy the same,
and after advertiseing for thirty days, shall
sell the properly levied on before the City

between the Legal boors of sheriff’s sale,
the said Marshall shall put up sail} prop
erly and shall offer the same in parcels

Sec. 32nd. And bp it further enacted
by the autority aforesaid that a Clerk and
Treasurer of the City of Oglethorpe
shall be Elected by the people of said
City qualified to vole for Mayor and Al
dermen at the said Election on the third
Saturday in Februrary Eighteen Hun
dred and fifty two, and at each regular
Election on the first Saturday in Janua
ry thereafter, and shall serve for one
year, or until his successor shall he duly
Elected and qualified. He shall give
bond in the sum of three thousand dojars
with two good securities conditioned for
the faithful performance of his duty as
Clerk and Treasurer of said City, and
shall take an oath that he will, to the
best of his skill and power, perfofip the
duties of Isis office without favor or affec
tion.
Sec. 33rd. And bf it further enacted
by the authority aforesaid, that tire act
heretofore passed “ incorporating” the
Town of Ogethojpe, together with all
law sand parts of laws militating against
this act be, and the same are hereby re
pp a led.

de Nicaragua by the Prometheus, at New
