VIEWS UN THE STOCK LAW
-HKAI) WHAT UKHAYH.
Tbe following address was deliv
ered by Commissioner Bntler tofore
the late Stale Aycultaral Conven
tion:
The subject of the stock Jaw is one
that interest' almost equally all daa>-
m ami every occupation in society
ftom the msn of millions to th« hew
er of wood and drawer of waler.
A» agriculture, to which this law
peeuli iry relates, is the eery source
of physical life and eomlort, the only
foundation of all material prosperity
and progress, it naturally divides
itself, lor dia< u«*ion, into two grand
div into t»: First, its mo al. legal and
equitable repict deeerece attention;
and. second, as «• measure of economi
cal expediency it is entitled to the
careful consideration ode wry patriot
ic and progressive mind. Under th*
first head, thn right of every man to
the eoU use of bis own property
night b* enlarged upon, carefully
refuting tbe proposition that custom j
can, nndi r any circumatauces, or
however long continued, confer vest
ed rights to tbe use of another a
property Cueto* can no mow than
might make right, of which truth tbe
South Ia« bail a most bitter experi
ence. Hosidee our condition has
cbangrd since the estaldi'hnient of
the old and effete avt'em of fencing
On the fits' sett I- merit of the o un
try, agriculture was the rmall.'r snd
comparatively insignificant iutereat,
and therefore rightly made to protect
itaelt by fencing from the greater
and more prominent interest In
fact, such prot'cion win render'd
neooesnry by the wild animals that
roamed tbe forest in oountleM num
ber
Now tbe whole system is reversed; 1
while agriculture counts its invest
m<*nia sad productions by hundreds 1
of millions, hundreds of thousands
woubl tell all of th J s ock interests. I
It is just, IhercL re an<t unqnestiona- I
bly rx|»e lient, in an economical point 1
of view, tbsl tbe now infinitely small- !
er must, in its turn, give way to the 1
larger and all-important interest. i
Under the second be id of economi
eel expediency, tbe diacnaaion tnigh'
be extended ind< finitely with state
Merits of an infinite number of tacts,
figures and illustrations.
Yn 1871 the National Agricultural
Department, iu a report upon the
coat of fences, estimated their coat in
A >rtb Carolina at $91,13(1,886, includ
ing ernes and boundary fences. It is
• well eat* 1 liabed fact that the cost ot
boundary fences is about *4 per acre.
Tbe last census shows that there
were in South Carolina 8,772,905
aerea of improved land. Katimat
ing tbe cost of boundry fences at II
per acre it would amount to 115,090-
<9O fur ft-noea alone The duration
of an ordinary rail fence is estimated
at ten years. With this annual depre
ciation of 10 per cent, and ink rest
at 7 per c«nt. upon the investment,
it ia ronoloaive that the boundary
fences coat the formers of South
Carolina annually $9,665,371.
The aboliMoo of fenoee in Sooth
Carolina amount to a remission of
all St ale and county taxe for twoyeara.
I regret toat I had not the alaUa
l>ca before me for arriving ala simi
lar calculation fur the State of Geor
gia, bat 1 feel aafe io easerting that
if made, it would prove that the Block
law would be equally advantageons
to thia State.
The no-fenc system th in the inter
est ot tbe rich landlord and hi« poor
tenant becanaeit is baaed np»n prin
• ciplea of equity, right and jttatice.
It iaa vast aavtug of labor and mate
rials, it brings thousand* of acre* into
eultivaltou that would otherwise lie
idle for the look of t her for fencing,
thereby inoreaein? its value. Lands
rapidly improve when stock are no
longer allowed to tramp and gras
there in and out of eeaaon. No
damage io contained on account of
fire and wind, on hedge rows to be
cleaned annually, no tiaae loot in
banting stock, wo quarrel* between
emghboro about joining fencing
Tbe tabor ta tbe early Spring re
qwirod to repair faeces can pe devot
ed to man urea and compoat and to
the proper preparation of land for
grain, which ha* always been neglect
ed; it censes totter beef, more milk ,
snd butter snd fatter work animals,
it permits farmer* to sleep without
f. ar of findi-g ih> tr crops destroyed
in tbe morning; checks the stealing
of atock; avoids tbe packing of land*,
rendering them tout liable to wash,
, more por< u« and more eipable of
• retaining mois'nre, causes m< re grain
I to be sowed, thereby er.c foraging
a divers fied agncnlture. These are
not reckless assertions, Lot the expe
. risnee of the farmers in the counties
i <-f Son h Carolina where the stock
law baa been in operation for sever
al years.
But, aside from al) the advantages
spoken of and many more that could
lie mentioned, the no-fouec l»w, view
ed in a pnr.-ly econ -nncal light, should
commend itself to our farmers.
I have no doubt but that the annu
al c at of building aud r pairing fell
oes in this Sts e < q ials, if it does uut
exceed, ibe ratio of all the catll
owned I'V the farmer* of (b-orgia
The last ceuaua shows that seven
'took law counties m ide one half of
all the butter produced in the Stale
and two thirds of the chee«e, and
owned less than one-fenrth of the
miloh cow-; they .laughtered neirly
one-ibinl of the beef killed in the
Stato and own only about one-fifth of
•h<- lieef cattle. Andrrson county the
first to adopt the law. made two hun
dred end sixty thousand pound* of
'butler, while Barnwell, where it wi«
not in o|>eratioti, which is tbe largest
corn producing county in the Stii',
with one thousand m 're milch cow
than indeiaon, made only thirty
thousand pounds.
These tacts prove conclusively that
while a siunller nnuilrer ol cstde are
kept in the Stock Itw counties, the
quality has greiily improved. This
is al«.> proven by the fact that at the
last Htite Fuir'm-arly every premium
for rock was awarded to Stock law
comities, which shows also that the
law encourage* the breeding ol be
ter stock
In the dilute npnn the bill to prr-|
vidsa General Stock law, in the
South Carolina Legislature, several
counties a«kcd exemption Loin tbe
law upon the ground that a large part
of these conntiv* com-istud ol ptue
barrens and swamp*, well adapted to
grazing | u piece and totally unsuitod
for cultivation In one ot these ooun
ties the cost of the fences .for one
year was 93,(88) and tu anol h r 12-
000, in excess of tbe value of all the -
milch cows and their products, milk,
butter and cheese.
The Secretary of ths North Caro
lina Board of Agriculture writes uit
that the law is giving perfect satis
faction in the counties of the State i
wh-re it has been ad p‘ed, and he
adda that where ever the law obtains
a great di-position to be embraced in
the territory affected by ia minifo.l
ed, and that cattle, bogs and sheep,
while fewer perhaps, in number, are
more valued, and receive belter at
tention. Tbeee statements are cor
roborated by the testimony of the
pec pie whvrcver the st- ok law ha
been tried.
The i arneot co-operation of our
sister State of Georgia, and the ad
joining S'ates, will not only be mu
tually advantageous t > us all, econom
ically, but will be the most certain
means of quieting and wholly elimi
nating this disturbing question from
our political issue*
The last ceoans reveled the won
derful progress of the South since th
devastation of her territory by invad
ing armies and the oppression of her
people by aliens and robbers.
