Interesting Case of Life We condense from tho Baltimore Patriot, th*} following article in reference to the liabilities of Life Insurance Companies; where tho insured party dies by his own hand: — We noticed a short time since in a Boston pa per, that a caso was about to come up for trial there, involving an important questiou in life insurance. The suit was ngainst a Life Insur ance Company, by the executors of a man who had killed himself, to recover the amount which i they had insured on the life of tho deceased.— ; Tho Company refused to pay,on the ground ihat . by thejtorma of the policy they were not liable; as the party had killed himself. On the other sido it was insisted that, as tho deceased was not in his right mind and therefore, not a re sponsible agent at the time, his self destruction Was not the act of suicide contemplated by tho policy, to ronder it a nullity. The point Tuvovled has been up before Courts in England, and al?o in this country; opposite decisions have been ‘given in tho two countrie-’ Aud it is a curious coinci lenco that tho cases u: England and here should have come up in the same year, 1803. This case in England ca ne up before the Court at the Easter torm of 1818; and was elab orately argued on both sides. The judges di” vdad on the domain*. The majority, however, decided, that though tho party was insane when | he killed himself, it made no difference—he I “diod by his own hand,” and thus committed suicide, and the right to recover the amount in sured on his life under the policy, was forfeit ed. In this country the decision was the other way. In this city, soruo years ago, ono of our most respe-.able citizons, while out at soa, walked overboard and was drowned. The evi dence was conclusive that ho was insane at the time. Ilis life had been insured, and the ques tion arose whether the policy had been forfeit- I oil. Tho opinion of one of tdje ablest members of the bar was taken, and ho gave a decided ! opinion that the company was bound to pay the f amount they had iusured on his life. After some hesitation, the matter was referred to the arbitration of another loading tnctnbor of the bar,and he deetdod that the policy had not boon forfeited, and tho heirs of the deceased accord ingly received tho sum insured ou his life. In New York, the point came up beforo the Supremo Court, in January, 1543, when a suit was instituted by Breasted, as executor, against the Farmer’s Loan Trust Company, to recover tho aiudunt insured oh life of Hiram Com fort, who had drowned himself in the Hudson river. It was proved that ho was insane when he droned himsolf, but Cite Company refused to pay becauso he had, whether in his right inind or not at tho time, committed suicide; which by the express words of the policy, re leased thorn from paying any thing under it.— On tho other side it was argued that a man who kills himself, whilst laboring tinder insanity, is not responsible for bis aot, and that; therefore, his killing hiiusolf, whilst insane, was not the act of suicide contemplated in tho policy. The opinion of the court pas pronouriced by Chief Justice Nelson, now of Ihe U. S. Supremo Coilftj arid vfras lit favor of tho plaintiff. He said that • ‘suicide involves tho deliberate tor minattion of one’s existence, whilc'ip tho posses sion and enjoyment of his mental faculties,” and that, therefore, “self-slaughter by an insane man, or a lunatic, is not an act of suicide within j the moaning of tho law.” So the insurance company had to pay tho amount insured on the life of the deceased. . Tho question is of general and deep import ance, and the decision of the court in Boston will, therefore, be looked for with interest. As the docision of ono State court does not control that of another, the decision iu New York will not be conclusive as to w hat, will be dope in ! Massachusetts, though, if the case be alike, that in New York will have some influence in deter mining the decision in Massachusetts. [From the Charleston Courier,] Cotton Packing. A writer in the Barnwell Sentinel reoords an experiment made in packing Cotton with anew | press, the invention of Mr* J. B. Armstrong, of j that District. Ho think's this new invention j may supersede tho screw—which was first ap plied to packing Cotton by a citizen of this State, j wo believe, who is now a resident of Laurens I District From this account wo extract tne fol- j lowing: The cotton put in a bng wo saw packed was only 3TO pounds, being all that was handy, tho bag was packed in twelve minutes, and tho screw run down ia two minutes, showiugara- \ pidity of execution far exceeding tho one now in uso. The contrivance like like all perma- ) nently useful inventions, is a very simple one, and I scarcely think more liable to got out of ordef than the common press or screw. It is ndaptod to steam, horse or water power, and I \ think it unquestionably a most inven tion. T am satisfied that all who so© it will go away with tho saino impression that I did, viz: of astonishment that a discovery so simple, so ad- 1 mirableand soalmostindispensable has not been made before. The perfliat ewe with which the cotton wa? [ forced into the small compass desired, was tru |ly astonishing. The gat* was shut down when I the follower laoked three inches ofbeing up, i and some apprehended some difficulty in start- I ing it again. But the gate was cracked scarce- I ly three iuohes, when tho press was in full mo tion again, apparently with undiminished 1 speed. lam forced into the belief that this iu j vention is an eminently successful one; and i have no doubt that Mr. Armstrong will be iu the end amply rewarded for tho genius, ability aud perseverance which ho has displayed. Important from Jamaica. The El Paraguay, from Charleston, anived l at Kingston on tho 24th ult., with two slaves on I board, who had been secreted by tho steward. ! Great excitement was occasioned by a ropji t that other slaves were found on board by the captain, and put in iron?. A mob of negroes assembled, nnd became so threatening, the ma gistrates were forced to search the ship to pacify them. In tho meantime, parties of negroes had gone off iu boats, and commenced an atta k on tho steamer, but they were effectually resisted. Another party of negroes went to Port Royal to induce tho Commodore to stop the steamer at that place, and subject her to another search, j which was refused. Quiet was finally restored, nnd the El Pura { guay protJedeed on her voyage, leaving the ( ! steward aud another colored tnan, who had been j induced by tho rioters to remain ut Kingston. I j The two slaves, who aro named 11. S. Ilarny ! and William Lewis, were kept in custody on board the steamor, and will he takeu back t 1 Charleston. They were not discovered until j Several days after the steamer left. Political and commercial affairs are very 1 unsettled at Jamaica, in consequence of a dif ficulty with tho legislature, which resulted in J throwing out the impost duly bill, and tho sub sequent prorogation of the legislature until the j 17th instant. All articles are now admitted j without duty being legally collectable. In con sequence speculators are hurrying off orders for i large cargoes to the United Slates. jfrO- Calvin R. Brown, late husband of tho j i well-known “spirit-medium,’’ Miss Fish, died ! reeontly in New York, and funeral services were performed cr. Thursday evening. The Tiibune states that during the ceremonies, au dible rappings were hoard from the coffin and elsewhere, evidently in responso to the senti ments uttered.— Exchange. Will the Tribune inform us what was the nature of the raps ? Perhaps it was ouly a di abolic tattoo, from some idler prelent who was desirous of producing serious impressions in the breast Os Horace, the almost-persuaded-to-be-a believer in the Knocking^. ‘-Hang all Concerned.” Alluding to the Course of the newspaper press relative to tho late disaster on tho New Haven Railroad, the Detroit Advertiser says :—Pas sion, in some degree, has taken the place of judgment in the consideration ofthc subject by the press, and a pretty general verdict of “HangrrH concerned,” has returned. This seems to |be going to the other extreme. Railroad Cos I panics and Steamboat owners are required by tho public to “make time.-—they are expected of course to carry passegers through in safety and they are sued if they do not, bat that is a minor consideration, the sine qua non being to make time—aline which does not make time is avoided, has a bad name, loses its business and sinks its stock in tho money market. Tho pub lic will is a law to all public lines of travel. Railroad managers are thus compelled to em ploy engineers who will mike time. The public make loud complaints when acci dents occur by tho headlong haste and reck lessness of engineers and conductors, but these i complaints', though loud, are not more frequent l than those which are made against slow run | nifig, nnd it strikes us that tho .public should ■ stand their share of the blame. In Engl a fid a I recent act of Parliament has limited all roads to Ia Spe'e iof thirty five milos per hour, affecting roads which have formerly made sixty or sev enty miles. Free Slaves. Our readers are acquanted with the practical results of emancipation iu tho British West In dia Islands, aud, iu particular, with tho various abortive efforts that hnvo been made to substi tute new classes of indentured laborers from tho East Indies for the liberated blacks, who do .not come up to the expectations originally in dulged in regard to them. The Cooley system lias proved a dead failure, it appears, both in the islands and on the Main, the Cooleys prov ing, from tho first, inefficient, and, of late, in some instances refractory—as in Demarara, whore the Governor recently found it necessary to resort to strict measures to quell a riotous spirit manifested by them, Tho latest scheme of tho British government to satisfy the clamor of the planters, whose con tinual cry is for more nnd better laborers, has been to contract with British houses to procure’ a supply of Africans. They are of courss, not ‘ to bo slaves; that is, they arc not called so; but . the government does not appear to require to know exactly whence they come or how they are obtained. In a large number of instances, the negroes forming the cargos of slave ships, | destined for Cuba or Brazil, when captured by British cruisers, have been taken to tho British colonies, and, under the namo of “liberated Af ricans;” have been “allotted” among tho plan ters—-whether with or without tho consent of the negroes themselves, is to bo conjectured.— Philadelphia North American. i \TEW KOOKS, received April 27 by S.
