Washington, January 11.—Representa
tive llurlburt, of Illinois, a member of the
Committee on Railroads and Canals, will
probably to-morrow introduce a bill, the
features of which he foreshadowed at the
moetiug of the friends of cheap transpor
tation last night, for the ooustruetion of
a double track freight ruilroad from New
York to Council Bluffs, with branches to
Chicago and St. Louis ; the railroad to be
constructed and operated by a company
under tho auspices of the Goueral Gov
ernment, and controlled by a Board of
Government Commissioners, the rates for
transportation to be fixed at five ceuts per
tou per mil* for auy distance over 700
miles. The trains will move at tLe quick
est rate of speed, which will bo at least
tou miles an hour. The cost of the road
is estimated at $175,000,000, including
the necessary rolling stock. Tho Govern
ment aid suggested is a guarantee of five
per cent, interest on $Ht),(>()(),(M)ft of bonds.
The capacity of tho road will be 00,000.

property of the United States.

Decision of Supreme Court.
Iu the case of Miller vs. Moses, ot al.,
from the Supremo Court of Appeuls of i
Virginia, the Supreme Court of tho United [
States held that a writ c.f error from this
Court to review the judgment of n Stuto
Court must bo issued to tbo highest court
of the Stato in which a decisiou of the
case could bo had, oven though that court
might be un inferior court of tho Stato.
Accordingly, where a Circuit Court of
Virginia hud jurisdiction to decido a caso
finally, the Court of Appeals of that
State, not having jurisdiction to review
tho decisiou by reason of the amount in
controversy being under $5,000, u writ of
error from this Court issued to the Court
of Appeals was dismissed. If allowable
at all, tho writ should have been issued
to the Circuit Court.
