The out involved the eoo*Hlatiooilitjr
of th* ordinenoe requiring fresh beef and
other articles to be cold only at the mar
ket bouse, during certain bean.
The Court decided the ordinance and
the law on wbieh it rooted to be uncon
stitutional ; because—
1st. “It was in violation of tb* 1st lec
tion of the Bill of Rights, whioh rays
that protection to person end property is
the peramonot dnty of government, and
■ball be impartial and oomplat*.
2d. “Tba ordinance la in violation of
2Cth section of th* Bill of Rights, which
mys that laws shall have a general opera
tion, .and no general law affecting private
righto shall be varied in any particular
oaaa by special legislation, except with
th* free oousent in writing of all person*
affsoted thereby.
3d. “The ordinance is in violation of
the whole spirit and intent of the Consti
tution, and ia such a restriction on trade
as ia in opposition and repugnant to th*
vety purpose of all government.”
The city baa already, through her at
torney, prepared papers to appeal to
Judge Johnson.
It wm thought that the writ of certio
rari would b* presented to Judge Jobn-
son last afternoon, but this was not done.
It will be in bia hands early to-day, and it
ia expected that an early hearing will lake
plaoe. The attorneys of the oity or* con
fident they will gain tba oaa* and the Isw
ba pronounoed constitutional.
In the meantime the oity authoritiee
are deteruked to enfore* th* Market or
dinances as heretofore, until tb* highest
jndicisl authority in th* State pronounces
them nail and void. Hanot it will be the
part o( wisdom for all market men to
observe them.
Mr. Bodkins hss been released under
the decision of Jndge Poo; bat if Judge
Johnson should reverse that view of the
lew, Usdkine must psy the fine of fifty
dollars impoaod by the Mayor, or serve
out the consequent imprisonment. Should
ha or others transgress ths ordinances,
until the higher jndioiai authorities hsve
rendered a decision, they will be arrested,
trisd, and if guilty, be punished *■ usual.
Tb* matter has by ne means been Bat
tled.
New MaU Agent Appointed BungUng
Arreei Mang Appttennte.
On Wednesday night, before they left
the oity, rho apeoial agents who effected
the arrest of Mr. Joe Martin appointed
Mr. Charles Collins, of Qirard, mail agent
on the Mobile and Qirard Railroad. Tha
naw appointee io a son of Mr. Dan Gol
lino.
The general opinion in this community
ia that the two special agents who effeated
the eneat ot Martin, acted very bungling,
ly in the matter. Had it not been for
the marked bill wbieh Martin, in hia
fright, handed tham, they would not have
bed a partiols of evidenoe to convict.
Both tha agents were in Montgomery, in
stead of one being here to make
the arrest and search on Marlin's arrival.
From the time he waa detained in the
post office, in accordance with their tele
gram, to their arrival on the Montgomery
train, ba had five boars in wbieh, unob
served, he could have destroyed the bill.
This detection doe* not impress one very
fsvorsbly with the keenness and skill of
tha 17. S. speoial agents.
By actual count nineteen persona ap
plied at tha post offloe for th* appoint
ment of route agent in Matin’s plaoe.
Each waa sadly disappointed when told
that the speoial agents had already
nsmsd his suooessor.

Holstesd A Co., of th* Colnmbna Agri
cultural Works, yesterday let Mr. A.
Gaoiel have one ot these meohines,
whioh they have for sale, for tha purpose
ot mowing the grass in tba beautiful and
spacious lot ot St. Luke's M. E. Ohurab.
Tha mower, drawn by two horses, did its
work expeditiously and well. Mr. Q.
gathered a goodly quantity of hay, and
the lot is much improved.
By the way, wouldn't it be a good idea
for Oounoil to buy one of these mowers
and use it for cutting down the weed* in
the street* of the oity and eemetery ? It
would osve much labor and trouble. Let
the Fathers refieot on th* matter.

Examination of tha school statietioo,

results:
Including the oity, there are in the

—288 whites and 3,837 oolored.
Tho average of the oounty, exolutiva
of the oity, shows that of those between
six end eighteen years, one in every
twenty white*, end one in every two and
a half colored, oen't read.
