Is Old Sledge a Game of Chance?
A novel case in jurisprudence recently
arose in New Hampshire. The statutes of
that State make it a misdemeanor to en*
gage in playing games of ehanoe for
money. In one of the smaller towns, a
disposition had arisen, among the more
staid und severely respectable portion of
the inhabitants, to enforce this law, which
had become practically a dead letter, and
it was determined to make an example of
two young men, detected while engaged
in the game of Seven Up. They were,
accordingly, duly indioted and all prepara
tions made for a speedy trial and
oonviotioo. Bob M , a rising young
limb of the law, bad undertaken the de
fence. Bob was a general favorite in the
towo, and had the reputation of never
having lost a. case. Bnt here was a poser.
The facts were too evident and too easily
proven to be denied, the law was plain, and
* success appeared hopeless. His intimate
. f rieuds endeavored to prevail upon him to
abandon the defence, representing that it
would be a pity to spoil nia record, which
was now so good, by undertaking a case
in wuich he could not help the prisoners,
aud which could only result in failure.
But Bob, confident in his own resources,
was firm in his refusal.
The case came on, and, having excited
muoh comment, a great throng of inter
ested spectators was in attendance, com
posed of the supporters tnd opponents of
card-playing.
When the prisoners wars arraigned,
Bob mated that his clients admitted that
they had played the game of seven-op,
id that one of them bad won and the
:her lost the sum of two dollars, as
..arged against them, but that they de-
ied that seven-up was • game of ehanoe.
ike proseouting officer smiled, and the
tadge pooh-poohed the idea; but Bob
‘'as not to be put down. The fact, he
fid, must be proven, like any other fact;
te rights of his clients were not to be
iflod with. Seven-up was a game of
•kill, and not a game of chance.
Toe Judge endeavored to ridicule him
out of bis position, but Bob was not to
be moved so.
Deacon Mudgett was called to the aland,
and testified that the sinful gsrne of
seven-up was, undoubtedly, and beyoud
all paradveuture, a game of chance.
Bob, however, was ready with a cloud
witnesses to show it to be a game of
jill. The case, he said, if tried in this
uy, would consume the whole term of
the court; that no other business could
o taken up; that, as the circumstances
ero peculiar, and as it was almost night,
he would suggest that the question be sub
mitted to a struck jury, composed one-
lialf of those holding Seven Up to be a
game of ohance, and one half of those be
hoving in the skill theory.
The court and prosecution assented and
the jury was selected. Deacon Mudgett,
foreman; Parson Brown, Deacons -Wil
kins, Bagley, Smith and Slooum, all ehanoe
men, and six old votaries of the game.
Cards and candles were supplied, and the
jury retired, leaving the audience with
numbers undimitiisked, and interest una
bated.
At the end of half an hour a message
was received from the jury-room; Deacon
Mudgett desired to borrow three dollars
from a friend. (Applause in court.)
Shortly thereafter, Parson Brown re
quested the loan of a small stake from
the Judge—(groans among the chance
men)—aud at the end of three hours the
4 jury returned with a verdiot, read by
Deucon Mudgett, which we give ver<
batim:
a “We, the jury empsuneled in this case,
W do noanimously agree, that the game
• known as seven-np, is distinctly and em
phatically a game of skill, and not a game
of chance; in witness whereof, we show
that during the evening the six ehanoe
men have never won a game, and never
turned a Jack ; and furthermore, that all
the money and other personal valuables,
lately in possession of the chance men
are now owned by the opposition party;
and wo farther certify, that the doctrine
that said game of seven-up is a game of
chance, is false and pernicious, and calcu
lated to inflict great pecuniary loss in any
oommunity that takes stock in it.”
Camels In Nevada.
Upon a ranch in Nevada on the Carson
river, there is a herd of twenty-six camels,
all but two of which were bred and raised
in Nevada. Some years ago nine or ten
camels were imported into that State, but
of these only two lived to become acclim
ated, and from this pair have been raised
the twenty-four. The men who now have
.them are Frenobmen, who had formerly
teme experience with camels in Europe.
They find no difficulty in rearing them, and
su now show twenty-four fine healthy au-
main, all of Washoe growth. The camel
•ay now be said to be thoroughly acclimat-
Jd m this State. The owners of the herd
|nd it no more difficult to breed and rear
hem than would be experienced with the
Bine uumber of goats or donkeys. The
auohe upon which they are kept is sandy
and sterile in the extreme, yet the ani-
oals feast and grow fat on such prickly
ibrubs aud bitter weeds as no other uni-
pal would touob. When left to tkeiu-
•Ives their groat delight, after filliug
bemselves with coarse herbage of the
' sort, is to lie and roll in the hot sand,
bey are used in packing salt to the mills
i the river from the marshes lying in
> desert some sixty miles eastward.
