Tom Woolfolk this niorning.

he must make answer to a suit for a total
divorce in the Superior court of Bibb
county.
Yeaterday afternoon Mrs. Woolfolk,
through her atto neys, filed a bill asking
tor a total divorce from her late husband.
In her petition she cites a number of facts,
all of which are well known, and ends by
citing the law giving lhe wife of a convict
legal aepamtion. Col. Rutherford was
served with a copy of the bill yesterday
afternoon, and whether or not the famous
prisoner has any answer to make to lhe
suit is not known.

If its doom has thus been settled,
why is such unfair warfare continued
upon It? Why are the railroads in
terested still exerting their great in
fluence against it? Why do their
lobbyists still besiege the legisla
ture?
It is possible—we cannot believe
it probable—that this combination
may succeed in defeating the bill.
But the constitutional mandate
requiring such a measure will reman
in force as binding aa ever. Its dis
regard by thia legislature will not
change the fundamental law of the
state, and no passive sanction of an
unconstitutional combination by one
legislature can restrain another
from dealing with it according to
the constitutional requirement.—

Mr. Lamlxiin was engaged to be
married to Miss Maggie Martin,
one of Eatonton's most beautiful
young ladies, on the eighteenth of
this month, and wm here on a visit
to hie betrothed, wbea suddenly
stricken with typhoid fever.
It was deemed best to have the
marriage take place on Monday
