SECUIRE DEBT
STATE OF GEORGIA,
COUNTY OF HOUSTON.
There will be sold before the Courthouse
door of Houston County, Georgia, between
the legal hours of sale on the first Tuesday
in September, September 6, 1994, to the
highest bidder for cash, the following
described property:
A fifty-two and one-half (52.5) percent
undivided interest in all that tract or parcel
of land lying and being in the City of Perry,
Land Lot 273, Thirteenth Land District of
Houston County, Georgia, being shown as
Parcel “A 1", containing 0.287 acres, Parcel
“A 2”, containing 0.292 acres, Parcel “B 1”,
containing 0.293 acres, and Parcel “B 2"
containing 0.298 acres, as shown by Plat of
survey prepared by Jones Surveying
Company dated February 18, 1992 and
recorded in Plat Book 41, Page 183, Clerk’s
Office, Houston Superior Court. Said Plat
and the recorded copy thereof are hereby
made a part of this description by reference
thereto.
This is the same property described in
an Executor’s Deed Under Power, dated
June 6,1989, of record in Deed 844, Page
436, said Clerk’s Office, and also in an
Administrator’s Deed Under Power dated
June 6,1989, of record in Deed Book 844,
Page 434, said Clerk’s Office.
Sale will be had under and by virtue of
the Power of Sale contained in a certain
Deed to Secure Debt dated June 20,1994
and recorded in Deed Book 1107, Page
229, Clerk’s Office, Houston Superior Court,
which Deed to Secure Debt corrects a
previous Deed to Secure Debt dated
November 9,1993 recorded in Deed Book
1059, Page 387-393, said Clerk's Office.
Said Deed to Secure Debt was given to
secure a note in the amount of $30,000.00,
due and payable on or before May 12,
1993, and because of the default in the
payment of said note, Jerry Williams has
exercised his right to declare this note in
default, and Jerry Williams has declared
the power of sale contained in said Deed to
Secure Debt to be operative.
Sale will be had and proceeds distributed
as provided in said Deed to Secure Debt
and by law.
The above-described property will be
sold subject to any outstanding ad valorem
taxes respecting the above-described
property, any easements and building
setback lines, restrictive covenants or any
other matters of record affecting said
