NOTICE OF SALE UNDER POWER
GERGIA, HOUSTON COUNTY
Under and by virtue of the Power of
Sale contained in a Security Deed given
by Fred Solomon and Martha L. Solomon
to Collateral Investment Company, dated
September 25, 1979, recorded in Deed
Book 560, Page 05, Houston County,
Georgia Records, as last transferred to
Federal National Mortgage Association by
assignment dated October 31, 1979,
recorded in Deed Book 562, Page
Houston County, Georgia Records,
conveying the after-described property to
secure a Note in the original principal
amount of THIRTY SEVEN THOUSAND
NINE HUNDRED & NO/100 DOLLARS
($37,900.00), with interest thereon as set
forth therein, there will be sold at public
outcry to the highest bidderforcash before
the courthouse dcor of Houston County,
Georgia, within the legal hours of sale ori
the first Tuesday in November, 1994, the
following described property:
All that tract or parcel of land situate,
lying and being in Land Lot 220, Fifth Land
District of Houston County, Georgia, which
is known and designated a Lot 5, Block
“O”, Jefferson Hills Subdivision, Extension
No. 4, according to a revised plat of survey
made by Waddle Surveying Company,
Inc., which revised plat of survey is recorded
in Plat Book 8, Page 126, Clerk’s Office,
Houston Superior Court. Said plat and the
record thereof are hereby made a part of
this description by reference thereto.
The above described property is subject
to a 10 foot sanitary easement traversing
said lot in an easterly to westerly direction
along the southerly portion of said lot.
Located on said property is a dwelling
house known as 109 Sherman Avenue,
accordilng to the nun-ering system of
Warner Robins, Georgia, and other
improvements, including a range,
dishwasher, wall-to-wall carpeting, vent
hood, garbage disposal, and back fence.
The debt secured by said Security Deed
has been and is hereby declared due
because of, among other possible events
of default, failure to pay the indebtedness
as and when due and in the manner
provided in the Note and Security Deed.
The debt remaining in default, this sale will
be made for the purpose of paying the
same and all expenses of this sale, as
provided in the Security Deed and by law,
including attorney’s fees (notice of intent
to collect attorney’s fees having been
given).
Said property will be sold subject to
any outstanding ad valorem taxes
(including taxes which are a lien, but not
yet due and payable), any matters which
might be disclosed by an accurate survey
and inspection of the property, any
assessments, liens, encumbrances,
zoning ordinances, restrictions, covenants,
and matters of record superior to the
Security Deed first set out above.
To the best knowledge and belief of the
undersigned, the party in possession of
the property is Fred Solomon and Martha
L. Solomon or a tenant or tenants and said
property is more commonly known as 109
Sherman Avenue, Warner Robins, GA
31093.

dated December 10,1990 from Ouida B.
Dearing to Transamerica Financial
Services, Inc. recorded on December 12,
1990, in Deed Book 901, Pages 321-322
in the Clerk’s Office of the Superior Court
of Houston County, Georgia, the
undersigned will sell at public out-cry during
the legal hours of sale before the doors of
the Courthouse in Bibb County, Georgia
on the first Tuesday in November, 1994 to
the highest bidder for cash, the following
described real property:
All that tract or parcel of land lying and
being in Land Lot 168 of the s*h District,
Houston County, Georgia, and being Lot
11, and a portion of Lot 10, Block O,
Section No. 8, Shirley Hills Estates
Subdivision, as shown on plat of survey by
Waddle Surveying Company, Inc., dated
February 6, 1962, and being recorded in
Map Book 7, Page 157, in the Clerk’s
Office Houston Superior Court, and being
more particularly described as follows:
BEGINNING at a point on the Southerly
side of Arrowhead Trial 805 feet Easterly
from the intersection of the Southerly side
of Arrowhead Trial and the Easterly side of
Chestnut Road (if said street lines were
extended to form an angle instead of a
curve); running thence South eighty nine
degrees thirty five minutes thirty seconds
East along the Southerly side of Arrowhead
Trail 155 feet to a point and corner; running
thence South twenty four degrees thirty
minutes West 180 feet to a point and
comer; running thence North eighty nine
degrees thirty five minutes thirty seconds
West 155 feet to a point and comer (said
point being 15 feet Easterly from the
Southwest comer of said Lot 10); running
thence North zero degrees twenty four
minutes thirty seconds East 160 feet to a
point on the Southerly side of Arrowhead
Trail and being the point of beginning.
Caption property includes all of Lot 11,
Said Block, Section and Subdivision, and
the Easterly 70 feet of Lot 10 said Block,
Section and Subdivision, as more fully
shown on a plat of survey of the property of
Howard H. and Ouida B. Dearing dated
March 16, 1967 and being recorded in
Map Book 11, Page 103, in the Clerk’s
Office, Houston Superior Court.
The debt secured by said Deed to
Secure Debt is evidenced by a mortgage
note dated December 10, 1990 in the
amount of $50,998.61 principal by Ouida
B. Dearing in favor of Transamerica
Financial Services, Inc.
The debt secured by said Deed To
Secure Debt and evidences by said
mortgage note has been and is hereby
declared due and payable because of the
grantors’ failure to comply with certain
terms and conditions in said Deed To
Secure Debt. The debt remaining in default,
the sale will be made for the purpose of
paying said indebtedness, including
accrued and unpaid interest thereon,
attorney’s fees and expenses of said sale.
The property will be sold as the property
of Ouida B. Dearing, who to the best of the
undersigned's knowledge and belief, is
the party in possession of said property.
Notice has been given of intention to
enforce provisions for collection of
attorney’s fees and forclosure in accordance
with legai requirements and the terms of
said Deed To Secure Debt and mortqaqe
note.
This property will be sold subject to any
and all unpaid taxes, assessmenst, general
subdivision restriction, if any, and other
restrictions and easements of record, if any.

Because of default in payment of
indebtedness secured by a Deed to secure
debt executed by Ben Allen to Shirley W.
Vassas, George Wallace Williams, Roy M.
Miller and Larry G. Snellgrove, dated March
13,1991, and recorded in Deed Book 910,
Page 601, Clerk’s Office, Houston Superior
Court, Roy M. Miller and LarryG. Snellgrove
having quit-claimed their interest to Shirley

record thereof are incorporated herein by

Said property is sold subject to an
indebtedness in favor of CB&T Bank of
Middle Georgia in the amount of $72,374.55
which indebtedness is not assumable.
Said property will be sold as the property
of Ben Allen by the undersigned as Attorney
in Fact for Ben Allen, and the proceeds of
said sale will be applied to the payment of
said indebtedness, the expense of said
sale, all as provided in said deed to secure
debt, and the balance, if any, will be
distributed as provided by law.

in the Deed to Secure Debt and Security
Agreement from Wayne J. Key to United
Finance and Development Company dated
February 6, 1991 and recorded in Deed
Book 906, Page 420, Clerk’s Office, Houston
Superior Court, there will be sold by the
undersigned United Finance and
Development Company at public outcry to
the highest bidder for cash, before the
courthouse door in Houston County, Georgia
within the legal hours of sale on the first
Tuesday in November, 1994, same being
November 1,1994, the following described

Said Deed to Secure Debt and Security
Agreement having been given to secure a
Note of even date, which Note has become
in default as to principal and interest, the
entire remaining indebtedness under said
Deed to Secure Debt and Securotyu
Agreement has been declared due at one
because of among other possible events of
default, failure to make payments due in
accordance with the Terms of said Note,
thereupon the POwer of Sale contained in
said Deed became operative. The debt
remaining in default, this sale will be made

Public Notice - Tax Exemption
"Certain persons are eligible for certain homestead exemptions
from ad valorem taxation. In addition to the regular homestead exemption
authorized for all homeowners, certain elderly persons are entitled to
additional homestead exemptions. The full iaw relating to each exemption
must be referred to in order to determine eligibility for the exemption. If you
are eligible for one of these exemptions and are not receiving the benefit of
the exemption, you must apply for the exemption between January 2
through March 31,1995, in order to receive the exemption in furture years.
For more information on eligibility for exemptions or on the proper method
of applying for an exemption, you may contact the office of the county tax
commissioner which is located at: 1005 Jernigan Street, Tomie S. Hunt
Bldg., Perry, GA 31069 or 200 Carl Vinson Parkway, Warner Robins, and
which may be contacted by telephone at: 987-2990, Perry Office, or 542-
2110, Warner Robins Office.
If you feel that your property has been assigned too high a value
for tax purposes by the board of tax assessors, you should file a tax return
reducing the value between January 2 and March 31,1995, in order to have
an opportunity to have this value lowered for next year's taxes. Information
on filing a return can be obtained from the county tax commissioners office
at the above address and telephone numbers.
The above information is required by state law and does not affect
this tax statement."
