Notice of Sale Under Power
Under and by virtue of the power of
sale contained in that certain Deed to
Secure Debt (the "Security Deed") execut
ed by Harley Construction Cos.
("Borrower") to Nationsßank, N.A.
(South) ("Lender"), dated May 10, 1996,
and recorded in the office of the Clerk of
the Superior Court of Houston County, in
Deed Book 1213, Page 108, the under
signed Lender will sell at public outcry to
the highest bidder for cash before the
door of the Courthouse of Houston
County, Georgia, during the legal hours of
sale, on the first Tuesday in May, to wit:
May 6, 1997, the following described
property, to wit:
All mat tract or parcel of land situate,
lying and being in Land Lot 150 of the
Fifth Land District of Houston County,
Georgia, known and designated as Lot 9,
Block "B", of An Addition of Phase No. I,
Camelot Villas, according to a plat of sur
vey of said property prepared by
Clements Surveying Cos., Inc., certified by
Walter G. Clements, Georgia Registered
Land Surveyor No. 1967, dated May 7,
1996, a copy of which is of record in
Map Book 48, Page 184, Clerk's Office,
Houston Superior Court. Said plat and the
recorded copy thereof are hereby made a
part of this description by reference there
to for all purposes.
The debt secured by said Security
Deed is evidenced by a Promissory Note
dated May 10, 1996, in the original prin
cipal amount of $61,200 (the "Note")
payable, principal and interest from the
date thereof at the rate of interest shown
on said Note on the unpaid balance until
paid.
Default has occurred in the payment of
the debt evidenced by the Note and
secured by the Security Deed as a result of
nonpayment of the indebtedness owed
thereunder. Accordingly, the total balance
of said debt has been and is hereby
declared due and the Security Deed fore
closable according to its terms.
The debt remaining in default, the
properly will be sold to the highest bidder
tor cash as the property of Borrower, the
proceeds to be applied to the payment of
said indebtedness, attorneys' fees (notice
of intention to collect attorney's fees hav
ing been given!, and the lawful expenses
of said sale, all as provided in the Note
and the Security Deed, said sale to be sub
ject to any and all unpaid taxes and
assessments, any matters which would be
disclosed by an accurate survey or by an
inspection of the property, any zoning
ordinances, all outstanding bills for public
utilities which constitute liens upon the
property, all restrictions, easements, liens
and encumbrances of record, if any, that
are prior to the Security Deed and to
whicn the Security Deed is subject, those
certain Protective Covenants recorded in
Deed Book 1167, Pages 512-516, said
records, easements for drainage and utili
ty purposes over, upon and across the
northerly twenty (20) feet of said property,
and maintenance and utility easement
over, upon and across the front five (5)
feet of said property, both as shown on
the recorded plat or survey of said prop
erty.
To the best of the undersigned Lender's
knowledge and belief, Borrower is now in
the possession of the property.

dated September 8, 1995, and recorded
in the office of the Clerk of the Superior
Court of Houston County, in Deed Book
1168, Page 452, the undersigned Lender
will sell at public outcry to the highest bid
der for cash before the door of the
Courthouse of Houston County, Georgia,
during the fegal hours of sale, on the first
Tuesday in May, to wit: May 6, 1997, the

All that tract or parcel of land situate,

- The debt secured by said Security

paid.
Default has occurred in the payment of
the debt evidenced by the Note and
secured by the Security Deed as a result of

Because of default in payment of
indebtedness secured by a deed to secure
debt executed by John Wesley Collier, Jr.
to The Bank of Perry, dated May 13,
1994 and recorded in Deed Book 1097,
page 750, Clerk's Office, Houston
Superior Court, the undersigned The Bank
of Perry, pursuant to the power of sale
contained in said security deed, will, on
the first Tuesday in May, 1997, during the

on the first Tuesday in May, 1997, to the

Superior Court. Said deed to secure debt
was executed to secure a promissory note
between the same parties of the same
date in the amount of $144,000.00,
together with interest from that date at a
rate of 8.5% per annum, principal and
interest being repayable in 60 payments
of $1,418.02 each beginning September
8, 1996 and continuing on the same day
or each month thereafter until principal
and interest were fully paid. Wachovia
Bank of Georgia, N.A. is the owner and
holder of saia note and said deed to
secure debt which secures the same. The
last payment made on said loan was
made tne payment due on January 8,
1997 and the payments due on the Bth
day of February and March, 1997 in the
amount of $ 1,418.02 each, together with
appropriate late charges have not been
paid, and because of said default in fail
ing to make said payments when due, and
in accordance with the provisions of said
note and of said deed to secure debt, the
undersigned has exercised its option to
declare the remainder of the debt and col
lectible, and the power of sale contained
in said deed to secure debt has become
operative. The said Dr. James C.
Bradshaw, Inc. Has been notified in writ

On or about April 25, 1997, the
above named local government will
request the Georgia Department of
Community Affairs (DCA) to release
Federal Funds under Title I of the Housing
and Community Development Act or
1974, as amended, for the following pro
ject:
City of Perry New Hope Neighborhood
Improvements - Phase II
(Project Title or Name)
Acquire and clear 6 dilapidated struc
tures. Acquire 1.07 acres of right-of-way
and 5 parcels Relocate 1 family.
Rehabilitate 16 houses.
Improve streets by installing 137 CY of
concrete base, 943 tons leveling course,
330 tons asphalt overlay, 218 SY asphalt
top, 114 tons asphalt pavement and asso
ciate items. Install 800 LF pedestrian walk
ways. Install drainage facilities to include
7,040 LF curb & gutter, 17 catch basins,
225 LF 15" pipe, 600 LF 18" pipe, 1,100
LF 24" pipe and associates items.
Install water facilities to include 2,100
LF of 6" PVC water main, 4 ea. fire
hydrants, 21 ea. service connections,
1.000 LF of 3/4" service lines and asso
ciate items. (Project Activities)
To provide adequate water, and
drainage facilities, improve streets and
install pedestrian walkways, To provide
adequate housing to 16 families Purposes
or Nature of the Project)

Finding of no significant impact

It has been determined that such
request for release of funds will not consti
tute an action significantly affecting the
quality or the human environment and,
accordingly, the above named local gov
ernment nas decided not to prepare an
Environmental Impact Statement under the
National Environmental Policy Act of
1969 (P.L. 91-190).
The reasons for such decision not to
prepare such Statement are as follows:
