Sealed proposals from Contractors will
be received by the Houston County Board
of Education, Owner, in the Board Room
of the Office of the Houston County Board
of Education, 1100 Main Street, Perry,
Houston County, Georgia, until 2:30 p m.
prevailing time on Aug 7, 1997, for the
construction of the Houston County
Elementary School #4, New Construction,
Kathleen, Houston County, Georgia.
At the time and place noted aDove, the
proposals for the project will be publicly
opened and read No extension of the
bidding period will be made.

Application for documents, together
with a deposit of SSOO 00 per set should
be filed promptly with the Architect
Bidding material(s) will be forwarded
Shipping Charges Collect, as soon as pos
sible. The full amount of deposit for One
(1) set will be refunded to each General
Contractor who submits a bona fide bid
upon return of such set in good condition
within ten (10) days after date of opening
of bids. All other deposits for complete
sets will be refunded less $250.00 for cost
of reproduction of documents upon return
of same in good condition within ten (10)
days after opening of bids
Parties failing to return plans within 10
consecutive calendar days date of bid
opening or parties returning plans in other
than "good condition" shall forfeit entire
amount of deposit; no exceptions.
Contract, if awarded, will be on a
lump-sum basis. No bid may be with
drawn for a period of 60 days after time
and date of opening.
Bids must be accompanied by a Bid
Bond in an amount not less than five per
cent of base bid.
Both Performance and Payment bonds
will be required in an amount equal to
100 percent of the Contract Price. All
Bonds shall be written by a Surety
licensed to Business in the State of
Georgia, listed on the Federal Register,
and Acceptable to owner.
The owner reserves the right to reject
any or all bids and to waive technicalities
and informalities.
The Local Board cf Education supports

Deed to Secure Debt executed by
Brian A. Keith and Marcy E. Keith dated
August 1, 1995, and recorded in Deed
Book 1165, Pages 692-696, Clerk's
Office. Houston Superior Court, the under
signed Verna C. Evans, of Floyd County,
Georgia has declared the entire amount
of said indebtedness due and payable in
accordance with the terms of said deed
and the note secured thereby; and pur
suant to the power of sale contained in
said deed, there will be sold by the under
signed at public outcry before the court
house door in the City of Perry, Houston
County, Georgia, on the first Tuesday in
August, 1997, same being August 5,
1997 within the legal hours of sale to the
highest bidder for cash, the following
described property, to wit: All that tract or
Eiarcel of land situate, lying and being in
and Lot 173, Fifth (sth) Land District,
Houston County, Georgia, being known
and designated as Lot 4, Block "C" Miller
Hills Estates Subdivision, according to a
plat of survey dated April 1953, and
recorded in Map Book 3, Page 242,
Clerk's Office, Houston Superior Court.
Said plat and the record thereof are incor
porated herein by reference thereto for all
purposes. The said Brian A. Keith and
Marcy E. Keith have been provided a
copy of the Note and Deed to Secure
Debt, as well as a copy of this Notice of
Sale by registered mail.
Said property will be sold as the prop
erty of Brian A. Keith and Marcy E. Keith
by the undersigned as Attorney in Fact for
Brian A. Keith and Marcy E. Keith and the
proceeds of said sale will be applied to
the payment of said indebtedness, the
expense of said sale, all as provided in
said Deed to Secure Debt, and the bal
ance, if any, will be distributed as provid

By virtue of the Power of Sale con
tained in the Deed with Power of Sale to
Secure Debt (the "Security Deed") from
Frank Tolbert ("Debtor'') to Middle
Georgia Bank ("Grantee"), dated June
11,1992, recorded in Deed Book 969,
page 788, Houston County, Georgia,
Records, said Security Deed securing (a) a
purchase money note dated June 11,
1992 in the original principal amount of
Seventy-five Thousand Forty-five and
No/100 ($75,045.00) Dollars, with inter
est as specified therein and (b) a second
promissory note dated August 25, 1994
in the original principal amount of One
Hundred Thousand Two Hundred Fifty and
.No/TOO ($100,250.00) Dollars, with
interest as specified therein, together with
any and all other indebtedness owing by

Land District of Houston County, Georgia,
and being known and designated as Tract
2 of Walter Watson Subdivision accord
ing to that Plat dated November 26,
1984, of record in Plat Book 27, page
187, Clerk's Office, Houston Superior
Court, said Plat being incorporated herein
for all purposes. Said property fronts for a
distance of 92.7 feet on Davis Drive and
runs back with even width 225 feet.
The indebtedness secured by the
Security Deed has been and is hereby
declared due because of the failure to
comply with the terms and conditions con
tained in the Note and Security Deed. The
indebtedness remaining in default, the
sale will be made for the purpose of
applying the proceeds thereof to the pay
ment of the indebtedness secured by the
Security Deed, accrued interest and
expenses of the sale and all other pay
ments provided for under the Security
