Deed, doted June 11,1997 (“Security
Deed') recorded in Deed Boole 1286,
Pages 247- 274, Houston County
Records (“Records*), executed by
Trendline Bone Fashions, Inc., o North
Carolina corporation (“Borrower*), and
delivered to The CIT Group/Commercial
Services Inc., a New York Corporation
(“Lender*, to secure any and all indebt
edness and obligations owing by
Borrower to Lender, including!, without
limitation, the indebtedness evidenced by
the following (a) that certain Secured
Promissory Note dated March 4. 1996,
made by Borrower to the order of Lender,
in the original principal amount of
$4,500,00.00, (b) that certain Secured
Promissory Note aoted June 11,1997,
made by Borrower to the order of Lender
in the original principal amount of
$1,000,000.00, and © that certain
revolving line of credit provided under

comprising 6 301 acres of land, and
being more particularly shown on a plat

comprising 14.310 acres and being
more particularly shown on a plat of sur

Home Fashions, Inc “, prepared by
Richard L. Jones, Surveyor on November
25, 1994, a copy of said plot being of
record in Plat Book 46, page 1 14,

Said plat and the recorded copy thereof

To the best of Lender's knowledge, the
Property is in the possession of Borrower
or other persons in possession with the
consent of Borrower The Property will be
sold on an "as is, where is' basis without
recourse against Lender and without rep
resentation or warranty of any kind or
nature whatsoever with respect thereto,
with no assurance afforded to the exact
acreage contained in the property
description and subject to, including, but
not limited to, all the following:
(a) all outstanding taxes (including
taxes which are liens, but not yet
payable), assessments and utility bills
which are valid liens and encumbrances
upon any of the Property and which are
prior in right to the Security Deed;
jb) all valid zoning ordinances,
(C) rights of tenants in possession as
tenants only;
(d) the right of redemption of the
United States Government, it any; and
(e) any and all easements, limitations,
restrictions, reservations, covenants and
encumbrances of record to which the
Security Deed is subordinate in terms of
priority.
At Lender's election to be announced
at the time the sale is conducted, Lender
may sell the Property in separate
parcels or os an entirety.
The indebtedness evidenced by the
Loon uocuments ana secured Dy the
Security Deed (the "Indebtedness") has
been declared immediately due and
payable because of continuing defaults
by Borrower under the Note and the
Security Deed, including, but not limited
to, Borrower's failure to pay amounts due
under the Loan Documents and
Borrower's failure to perform its obliga
tions under the Security Deed
The proceeds of the sale of the
Property shall be applied in accordance

C Powell jr has declared the entire
amount of said indebtedness due and
oavable in accordance with the terms of
