in favor of Capital City Bank, secur
ing a note of even date in the origi
nal principal amount of
$2,082,713.50, said indebtedness
being due and payable in accor
dance with the terms and conditions
contained in said note, and said se
curity deed being of record in Deed
Book 3338, Pages 8-14 and trans
ferred and assigned to CHM Acqui
sition Co., Inc , dated May 16, 2006
and recorded in Deed Book 3840,
Pages 161-162, Clerks Office,
Houston Superior Court.
By virtue of the power of
sale contained in said deed to se
cure debt, there will be sold by the

The Perry Land
Development Ordinance
Notice is hereby given:
the Perry City Council will hold a
public hearing on Tuesday, July 18,
2006 at 6 p.m. in the Perry City Hall
for the purpose of receiving any
comments relative to amending the
Perry Land Development Ordinance
as follows:
Section 119 - Conservation Subdi
vision - This is an amendment to
permit clustering of houses and
structures on less environmentally
sensitive lands which will reduce the
amount of infrastructure necessary
for residential development. The
amendment will preserve in perpetu
ity unique or sensitive natural re
sources such as groundwater, flood
plains, wetlands, streams, steep
slopes, woodlands and wildlife habi
tat.

amendment can be reviewed at the
Community Development Depart
ment in the Perry City Hall.
