BASIS OF AWARD
The contract, if awarded, will be on a
lump sum basis by Base Bid.
Bid Prices
Bid prices will be held firm and re
main open for acceptance for sixty
(60) days from the time and date of
the bid opening, except as expressly
provided by law.
Bid Security
As security, the bid must be accom
panied by a BID BOND, in the form
required by DCSD for an amount not
less than five percent (5%) of the bid
if the bid is $100,000 or more (in
cluding the base bid plus any pos
sible combination of alternates that
could result in an award of $100,000
or more).
PERMITS
The successful contractor shall ob
tain all federal, state and local per
mits required for the Project, if any.
RIGHTS OF WAY AND EASE
MENTS
All rights of way and easements anti
cipated for the Project, if any, have
been obtained.

Performance and Payment Bonds
from a surety satisfactory to DCSD
must be furnished by the bidder
awarded the contract in an amount
not less than 100 percent (100%) of
the contract price if the contract price

Pursuant to O.C.G.A. § 16-13-49(n),
you are hereby notified that on
November 8, 2011, the property de
scribed below was seized at 956 Wil
low Run, DeKalb County, Georgia by
Detective P.S. Krieg of the Dun-
woody Police Department:
a. Approximately 51.52 grams of co
caine; and
b. Approximately 28 grams of
marijuana; and
c. One thousand twenty eight dollars
($1,028.00) in U.S. Currency; and
d. Bersa .38 caliber pistol, SER#
471443.
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of co
caine and marijuana.
b. was found in close proximity to
said cocaine and marijuana; or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, on November 8,
2011 Officer R.R. Weber # 2829 was
patrolling the area of Redan Trail and
Redan Road. At that time Officer
Weber observed a Silver Chevy Co
balt occupied by a Black male travel
ing Westbound on Redan Road. Of
ficer Weber noticed that the Black
male was not wearing a seat belt and
was smoking a Brown cigar. Officer
Weber then got behind the vehicle at
a Red light at the intersection of
Redan Road and Fieldgreen Drive
and attempted to initiate a traffic stop.
The vehicle then pulled to the left
side of the road into oncoming traffic
and began driving away from Officer
Weber through a Red traffic signal.
Officer Weber then pursued the
vehicle into a neighborhood in the
area of Nimblewood way. As officer
Weber was looking for the vehicle cit
izens in the area informed Officer
Weber of location of the vehicle. Of
ficer Weber then observed the
vehicle pulling into the driveway of
956 Willow Run. At that time Officer
Weber observed the Black male jump
out of the vehicle as it was still mov
ing while carrying a dark colored bag
in his hands. Officer Weber then pur
sued the Black male on foot
throughout the neighborhood and ob
served the Black male throw the dark
colored bag he was carrying behind a
house. After a brief foot chase Of
ficer Weber was able to take the
Black male into custody after a Taser
device was deployed. The Black
male who was identified as ++Mr. An-
rique Rashaad Zachary++ stated to
Officer Weber that the only reason he
ran was because he was smoking a
“Blunt” (marijuana Cigarette) and he
didn’t have a driver’s license. The
dark colored bag that Mr. Zachary
threw behind the house while he was
running was recovered by Officer
Duren and identified by Officer
Weber. Officer Duren looked through
the bag and located 2 bags that con
tained a White chalky substance, a
pill bottle and a Bersa .380 caliber
handgun. Mr. Zachary stated to of
ficers that the dark bag was not his
and that he threw down a shirt in the
area of the bag. Officers went back to
the area where the bag was re
covered but did not observe a shirt at
the location. A pat down of Mr.
Zachary revealed 1 large stack of
money in his left front pocket and 2
stacks in his right front pocket. The
white chalky substance field tested
positive for cocaine and had a field
weight of 51.52 grams. The green
leafy substance which was later iden
tified as marijuana weighed approx
imately 28 grams.
Mr. Zachary was arrested and trans
ported to the DeKalb County jail for
Obstruction of a law enforcement of
ficer, Trafficking cocaine, possession
of marijuana and driving without a li
cense. The U.S. currency that was
seized at the scene was transported
to BB&T Bank where it was counted
by an employee and determined to
be $828.00. The currency was then
deposited in an account at the bank.
Zachary was charged with Violation
of the Georgia Controlled Sub
stances Act. The cocaine and
marijuana are subject to forfeiture
pursuant to O.C.G.A. § 16-13-
49(d)(1). The currency is subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(2) and (d)(6). The weapon is
subject to forfeiture pursuant to
O.C.G.A. § 16-13-49(d)(4).
Pursuant to O.C.G.A. § 16-13-
49(n)(3), any claim to the seized
property must be sent within thirty
days to the seizing law enforcement
agency AND to Deputy Chief Assist
ant District Attorney, Kenneth
Hutcherson, by certified mail, return
receipt requested.

scribed below was seized at 922 Old
Know Drive, DeKalb County, Geor
gia by Officer Mercado of the Atlanta
Police Department:
a. Approximately 13 pounds of
marijuana; and
b. Two thousand seven hundred
ninety dollars ($2,790.00) in U.S.
Currency
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of
marijuana;
b. was found in close proximity to
said marijuana; or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, on November 17,
2011 Atlanta Police were conducting
a supervised safety check point at
Maynard Terrace at Memorial Drive.
A blue Chevrolet Lumina ap
proached the checkpoint and the
driver later identified as ++Antonio
Boswell++ presented Atlanta Police
with a paper copy of a Georgia Identi
fication card. Atlanta Police asked
Mr. Boswell for his driver’s license
and Mr. Boswell informed Atlanta Po
lice he didn’t have his license on his
person. During a check of Mr.
Boswell driver’s license, Atlanta Po
lice discovered he was unlicensed.
While speaking with Mr. Boswell At
lanta Police could smell an odor of
raw marijuana coming from inside the
vehicle. Atlanta Police removed Mr.
Boswell from the vehicle and in
formed him he was under arrest for
driving without a license. Atlanta Po
lice recovered 2 black plastic trash
bags which contained thirteen indi
vidual sealed gallon size clear plastic
zip lock bags of suspected marijuana,
approximately 13 pounds, sitting in a
child’s seat next to Mr. Boswell’s son
in the rear seat of the vehicle. At
lanta Police also recovered
$2,790.00 in U.S. Currency from the
person of Mr. Boswell.
Boswell was charged with Violation of
the Georgia Controlled Substances
Act. The marijuana is subject to for
feiture pursuant to O.C.G.A. § 16-13-
49(d)(1). The currency is subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(2).
Pursuant to O.C.G.A. § 16-13-
