Parent can challenge
temporary guardianship

My sister filed for
Temporary Guardianship
and claimed she didn’t
know where I lived. How
do I get my son back?

ble! It is a shame how often
families cause problem for
each other.
The answer to your ques
tion is a pretty simple one. I
am going to assume that you
are either the mother or the
legal father.
If that is so, all you need
to do is challenge the guard
ianship that was granted by
filing a motion in Probate
Court, in part, challenging
the lack of your notice of the
original proceeding.
However, you will need
to be prepared to explain
why you were not providing
for and protecting, your son
at the time the order was
granted; the Probate Judge
would still have some discre
tion to decide what to do,
given your absence in the
past. Good luck!

that you and your husband
have resolved your martial
problems.
Divorcing spouses some
times are shocked by the
financial and emotional con
sequences of a separation.
Time has a way of heal
ing the differences between
spouses, especially when
they remember why they fell
in love in the first place.
One of the elements of a

Many go through each day
typing on a computer, bend
ing or lifting items, garden
ing, taking care of children
and playing sports. If not
done properly, these activi
ties can cause pain or injury
which may become chronic if
left untreated.
Because of the importance
of taking care of the back
and spine, doctors of chi
ropractic are using their
knowledge of the spinal col
umn and nervous system
to promote the American
Chiropractic Association’s
national observance, Spinal
Health Month, during the
month of October.
“Back pain is pervasive in
our society. Eighty percent of
us will suffer from it at some
point in our lives, and fifty
percent of us will suffer from
back pain this year alone,”
said Dr. Kelly J. Law, DC of
the Butler Chiropractic &
Wellness Center. “Low-back
pain is the most common
work complaint experienced
by Americans today. Many
Americans today are health
and body conscious. We want
to look and feel our best by
taking care of our bodies
- exercising, getting regu
lar dental and eye exams
and by getting enough sleep.
In doing so, we ignore the
focal point of where much of
the pain associated with our
daily activities originates
- our spine,” Law added.

divorce is that the parties
have continuously lived in a
state of separation from the
time alleged in the divorce
petition.
So, technically, when the
parties reconcile, even if
they do not formally agree to
drop their claims for divorce,
that automatically destroys
one of the facts necessary to
proceed with the divorce.
This means that, if you
reconcile, in the middle of
a divorce, and then later
change your mind, you
might be required to re-file
the divorce as the initial
divorce proceeding should be
automatically dismissed by
the judge when this evidence
of reconciliation is presented
by either
spouse.
Of course,
if either
party
seeks a
divorce
again,
the entire
marriage
would be
consid
ered in

The situation is a bit dif
ferent where the parties
actually divorce, remarry,
and divorce a second time
(yes, this does happen, more
than you might think).
What lay people do not
often consider is that the
final decree in the original
divorce proceeding decides
all issues between the par
ties up until the divorce.
As such, if you marry for
20 years and agree to terms

ing in headaches, low-back
and neck pain, among other
problems.
Listen to your body. Use
preventative measures at
work and at home. Law sug
gests the following tips to
help reduce the risk of spinal
injury:
■ While at the office,
remember to take frequent
stretch breaks while work
ing on your computer. The
more hours per day you use
your computer, the great
er the risk of discomfort or
injury.
■ While working on your
computer, sit with your
knees at approximately a 90-
to 120-degree angle. Using
an angled foot rest to sup
port your feet may help you
sit more comfortably.
■ Make sure your chair fits
correctly. Allow for two inch
es between the front edge of
the seat and the back of your
knees. The chair should tilt
back so you can rest while
you’re reading what is on
your computer screen.
■ Avoid twisting and turn
ing motions. Always bend
from the knees, not your
waist, when lifting anything
heavier than ten percent of
your body weight, such as a
child or a heavy box.
■ Warm up and stretch
before any physical activ
ity, including all sports, rak-

(like waiving your right to
your husband’s alimony),
remarry, divorce after five
years, and want to seek ali
mony in the second divorce,

the jury only consider the
five years of the second mar

erty damages) or for any
other damage (property or

also cover the wreck.

good night’s rest. Choose a

supports the weight of your
head, reducing the risk of
back or neck pain.
The key to spinal health
is prevention; listen to your
body’s warning signals and
adjust your lifestyle. If you
do experience pain for more
than one or two days despite
using these preventive mea
sures, consult your local chi
ropractor.

Appreciative inquiry is an
alternative to problem-solving
In past articles, I’ve
described procedures for
building leaders in your
organization. I’ve pointed
out that most people assume
“leadership development”
means working on overcom
ing your weaknesses.
However, several of my
articles have emphasized an
alternative, often superior,
approach—that of enhanc
ing existing strengths.
A parallel exists in the
realm of organization
al change. Traditional
improvement techniques
emphasize the problem
solving approach. The spot
light is on what is wrong or
broken. Energies focus on
the largest problem, diag
nosing it, proposing alter
native “fixes,” and choosing
a solution path that seems
most likely to eliminate or
minimize the undesired sit
uation.
Appreciative inquiry
looks for what has worked
and is currently healthy.
Descriptive statements are
grounded in real experience,
not speculation or theory.
Participants recall memo
ries of success and build on
each other’s energy, gen
erating a new enthusiasm
that is positive and syner
gistic.
A basic premise of this
approach is that we become
what we think about. If we
focus on problems, we find
problems. If we focus on
what is working well, we dis
cover more that is good, and
we can build a future state
where “the best” becomes
routine experience.
The concept can be
understood by looking at
both words individually.

Problem-solving
approaches to organization

siveness. Through valuing
the best of what is and

appreciative inquiry tends
to generate freedom—to be
heard, to dream, to contrib
ute, to be positive, and to be
supported, both as an indi
vidual and as a contributor
to'the success of the orga
nization.
It may be helpful to offer
some questions typical of an
appreciative inquiry:
■ Describe a high point
in your experience, when
you felt most effective and
engaged, vibrant and alive.
What made that situation
possible?

ated the concept. Much of;
