hours of sale, on the first Tuesday in
November, 2006, same being No
vember 7, 2006, all of the following
described property:
All that tract or parcel of
land lying and being in the Town of
Elko in the Thirteenth Land District
of Houston County, Georgia, and
being further described as Lots 97
and 98 in Block No. 12 as shown on
plat of survey of the Town of Elko as
recorded in Map Book 1, Page 254,
Clerk's Office, Houston Superior
Court. Said plat of survey and the
recorded copy thereof are hereby
made a part of this description by
reference thereto for all purposes.
' The debt evidenced by
this instrument cannot be assumed
without the express written consent
of Grantee. If any interest in the
property is transferred or sold by
Grantor without Grantee's prior writ
ten consent, Grantee may, at their
option, declare all sums secured by
this instrument to be immediately
due and payable.
The debt secured by said
deed to secure debt has been de
clared due because of default in the
payments thereon, and in the due
performance of the covenants
therein contained. The debt remain
ing in default, this sale will be made
for the purpose of paying same and
all expenses of the sale, including
reasonable attorney's fees.
Said property shall be
sold as the property of TOM SAW
YER and ELLEN SAWYER and their
successors in title, subject to out
standing ad valorem taxes, ease
ments, and other matters as will oth
erwise appear on the public records
in Houston County and other restric
tions of record. To the best of the
undersigned's knowledge and infor
mation, the above described prop
erty is presently in the possession of
TOM SAWYER and ELLEN SAW
YER.
The giving of notice in
compliance with Official Code of
Georgia Annotated Sections
44-14-162 through 44-14-162.4 has
been accomplished by letter to Tom
Sawyer and Ellen Sawyer and sent
certified mail, return receipt re
quested.
The undersigned will exe
cute a deed to the purchaser at said
sale as provided in the aforemen
tioned deed to secure debt.
