Trustee accused us
misconduct
(MNS) - One of James
Brown’s estate trustees
might have misappropriated
hundreds of thousands of
dollars of the late singer’s
money, court papers filed
this week allege.
The attorneys appointed
by the court to help settle
Brown’s estate want David
Cannon removed, accusing
him of possible misconduct
before the singer’s death on
Christmas Day.
The other two trustees
- Buddy Dallas and Alford
Bradley - also could be
removed if a judge grants
the special administrators’
motion filed Tuesday in
Aiken County Court.
It’s not the only allegation
the three men are facing.
The funeral director who
maintained Brown’s body
for several weeks until he
was buried on his daughter’s
property says the trustees
still owe $17,995 for the
December funeral.
But the more serious alle
gations come from Adele
Pope and Robert Buchanan,
who were hired by the court
after the singer’s children
accused the three trustees of
mishandling their father’s
estate. In papers filed on
Tuesday, the special adminis
trators ask Judge Jack Early
to remove “one or more” of
the trustees but do not say
whom they want gone.
However, the rest of the
five-page motion focuses on
financial transactions that
Cannon handled and funds
his companies received from
Brown.
The administrators also
want Cannon, Dallas and
Bradley to turn over finan
cial records related to the
estate and the trusts, and
they want access to comput
er files in Cannon’s posses
sion. Cannon and Ms. Pope
did not return messages left
for them Wednesday.
Buchanan just said, “I

think the motion speaks for
itself.”
That motion says that in
July 2006, Universal paid
Brown $900,000 in a check
delivered to Cannon, who
deposited it into the James
Brown Irrevocable Trust.
Cannon then made several
deposits and debits from the
account, the special adminis
trators found, including two
checks he wrote to his own
company - one for $50,000
on Dec. 12 and the other for
$350,000 paid on Dec. 28,
three days after the singer’s
death.
The $350,000 check was
actually dated Dec. 22, 2005,
but the special administra
tors say they do not know
when it was deposited.
That money is in addition
to nearly $744,000 Brown
paid in 2006 to another
Cannon business, Seventh
Decade Productions, the
motion states.
The special administrators
“believe that one or more
of the above transactions
may be a serious breach of
trust,” they wrote, noting
that Dallas and Bradley deny
knowing anything about the
money and say they learned
of it when the special' admin
istrators did.
Dallas referred to it as
“another motion by Ms.
Pope,” and said, “I don’t
have any comment about
it.”
A hearing on the motion
before Judge Early is sched
uled for Aug. 10 in Bamberg
County. There are several
other outstanding issues
related to Brown’s affairs,
including the question of
paternity of the 6-year-old
boy who bears his name.
His disputed fourth wife
is still suing for a share
of the estate as his “omit
ted spouse,” and six of the
singer’s children have filed
papers accusing the trustees
of trying to sell off estate
assets in violation of a court
order. And his funeral still
hasn’t been fully paid for.

“I have no idea,” Reid
said, when reached in
Philadelphia. “I have called
in reference to it, and no
one has responded to it. So
I filed it in the courts just to
make sure.”
Reid said he’s been told
that funeral expenses for
Brown, including a service in
New York, topped $170,000.
Walker appeals to
full court

In a statement released
to reporters Wednesday,
family spokesman Kenneth
Walker - who is not related
to Charles Walker - said
the former senator had
petitioned the circuit court
for an “en banc” appeal. A
three-judge panel from the
court unanimously reject
ed Charles Walker’s initial
appeal last month.
The petition for the en banc
hearing was filed Friday.
Kenneth Walker also said
Alan Dershowitz, a nation
ally known lawyer whose
previous clients include O.J.
Simpson and Mike Tyson,
would join Charles Walker’s
defense team.
Walker’s initial appeal
to the circuit court had
argued that four jurors were
improperly seated, that the
jury got the wrong instruc
tions on the charge of mail
fraud, that prosecutors were
charging him with violation
of state ethics laws and that
Bowen added too much time
to his sentence.

BEN WILLIAM ALLEN
BONAIRE - Ben William Allen, 69 yrs old, of Bonaire,
Georgia died Tuesday, July 31, 2007 after a courageous
battle with Heart Disease. Visitation services - Heritage
Funeral Home, Friday Aug. 3, from 6-
8 p.m. Funeral services will be held at
First Christian Church, 2100 Highway
41, Perry on Saturday Aug 4, at 11 a.m.
He was the son of the late A.N. (Jake) &
Mary Allen of Canton, MO. where he grew
up attending 12 years of public school and
four years of college. Upon his graduation
from Culver Stockton College (1963) with a
BA in Business Administration, he and his
first wife, Pat and daughter Lynn, moved
to Winston-Salem, NC. There he became
the developer and owner of Allen Wrecking
and Demolition (for over a decade) and served as an officer
in the Winston Salem Volunteer Police Reserves. While in
Winston-Salem he also was very active in politics at both the
local and state level, taking pride in helping to elect the first
Republican Governor of North Carolina.
In 1975 Ben moved to Warner Robins, Georgia and began
his construction business, Brush & Nail, which he ran for
over 30 years. He married Marlene Comer Wilson in 1982
and became a faithful, loving husband to her and a loving
stepfather to her three children. He played a very positive
and active role in the lives of the children and considered them
to be his own for the rest of his life. He was proud of all four
of his children and his six grandchildren. He talked of their
accomplishments frequently to anyone who would listen.
Enjoying life to its fullest, Ben remained God focused and
was an ambassador for Christ to many people in various
walks of life. He never met a stranger. He was a member
of the First Christian Church of Perry where he served as
a deacon. His example of trusting God in all things was a
positive influence in the lives of his family and he was proud
to be able to say that all of his children and grandchildren
lead Christian lives.
Ben was known as an avid storyteller and prankster,
a competitive card and games player, and a good friend
to many people in the middle Georgia areas of Bonaire,
Warner Robins, Perry and Macon. While in business here he
was an active member of the Warner Robins Civitan Club,
the Houston County Clean Community Commission, the
Bonaire Boys’ Club and even after retirement he remained
very active in the Republican Party serving as a Georgia
State Delegate in 2007. He worked tirelessly on several
campaigns for both local and state Republican politicians.
He was a loving husband, father, grandfather and positive
mentor to many under his employ. He had many friends
and will be sorely missed by them as well as his family.
He was preceded in death by his parents and his sister, Marilyn
Joan. Ben is survived by: His loving wife, Marlene; his sis
ter Barbara Schafer (Larry); daughter, Lynn Elkins (Ken);
stepdaughter, Wendy Shaw (William); stepson, Jim Wilson
(Amy); stepdaughter, Donna Wilson; grandchildren, Quinn
Elkins, Carly Elkins, Jessica Wilson, Ethan Wilson, Noah
Wilson, and Autumn Wilson; two nieces and three nephews.
Flowers accepted or donations may be made to the First
Christian Church or the Georgia Sheriffs' Youth Homes.

Prosecutor claims a jailed MD
is using a county computer

on murder and drug charg

County Sheriffs Office com
puter and could be using it
to post Internet messages
about his case, court docu
ments show.
On one online forum, par
ticipants have hotly debated
in recent days whether one
particular poster is Noel
Chua, the doctor charged in
the drug overdose death of
his roommate.
On another, a poster iden
tifying himself as Chua, dis
cusses evidence in his case
and accuses the prosecutor
of misleading the grand jury
that indicted him.
“Thanks for fighting for
my cause,” he wrote the
forum host. “I am tempted
to fax to you what I consider
as one of my strongest pieces
of evidence.”

be required to provide evi
dence in his criminal case. In
. addition to Chua’s potential
postings, Johnson’s petition
says the TOPIX site con
tains information about the
crime that hasn’t been pro
vided to law enforcement.
That information came from
witnesses whose identities
have been concealed, the
petition says.
The doctor was arrested
on murder and drug charges
in September, nine months
after he found James B.
Carter 111 dead inside his
Osprey Cove home. A grand
jury charged that Carter, 20,
died from drugs prescribed
by Chua and that none of
the drugs were for a legiti
mate medical purpose.
