Conduct giving rise to seizure and

Warner Robins Police officers made
contact with James Kincaid at 750
Russell Pkwy in reference to a de
fected windshield. The passenger
of the vehicle, Chris Mace, fled the
scene on foot carrying a black back
pack. Mr. Mace was observed
throwing the back pack onto the roof
area of Russell Elementary School
and was arrested a short time later.
Inside the back pack was a large
amount of marijuana and a Taurus
.38 revolver. Ofc Flood searched Mr.
Mace and found $3,524.00 on his
person. Mr. Kincaid was observed
placing a black computer bag under
a van. The bag inside contained a
large amount of marijuana. Mr. Kin
caid advised that he owned the
1996 Ford Crown Victoria that both
subjects were in.

was being used or intended for use,
