To the Honorable the Superior Court of said, county-
T HE petition of Robert Mitchell sheweth, that
heretofore, to wit: on the seventh day of Au
gust, eighteen hundred and thirty, that the said Lir-
hin Cleveland, made, executed and delivered to your
petitioner his certain deed of Mortgage, bearing date
the day and year aforesaid, which is here in Court
ready to be shewn, which deed of mortgage convey
ed to your petitioner two lots in the Town of Gaines
ville, Hall county, Georgia, known by lots number
six and number twenty, in the said town of Gaines
ville, being the House and’ Lots then occupied by
Jonas W. Shaw; which said two town lots v.*ere mort
gaged by the said Larkin Cleveland, for the hotter se
curing to your petitioner the payment of a certain
promissory note, made and delivered to your peti
tioner by tho said Larkin Cleveland, for the sum of
two thousand five hundred dollars, dated on the day
and year aforesaid, and due on the first day of Jan
uary, eighteen hundred and thirty-three, to bear in.
terost after the first day of January eighteen hundred
and thirty-ono, and which is here in court ready to
be shown.
And your petitioner further sheweth, that the
whole amount of principal and interest is now due
and unpaid on said note: Wherefore he prays that
unless the said Larkin Cleveland docs pay into the
Clerk’s office of this Court j the amount of the princi
pal, interest and cost due thereon, within six months
from this dato, the equity of redemption in and to the
uortgaged premises thenceforth and forever be bar
red and foreclosed.
Therefore, on motion of counsel for plaintiff, it is
ordered by the Court, that the said Larkin Cleveland
pay into the Clerk’s office of this Court, the amount
of the principal and interest now flue on said note,
together with all legal cost, on or before t:he expira
tion of six months, otherwise the equity of Redemp
tion, in and to the mortgaged premises, lie forever
barred and foreclosed, and that a copy of this rule
and petition be published once a month for nix months
in some one of the public Gazettes of this Stifte, or
that the defendant be served therewith three months
before the next sitting of this Court.

5th. The Senior Assistant will be charged with the
business of procuring Mail Portmanteaus, Canvass
Bags, Locks and Keys, and with'all the incidental
duties. A clerk shall be assigned to aid him in their
performance, who, under the direction of the Assist-
ants, respectively, shall keep the registry of the
checks countersigned by them.
6th. The business of forwarding Blanks for Ac
counts, Locks, Keys, Post Office Lists, Laws, &.c
shall be performed under tho direction of the As.
sistants, within their respective Divisions.
7th. Tho principal Clerk of the Division only,
shall sign official correspondence, and that, in case of
tho absence of the Assistant.
8th. The third Division, will be that of finance,
under the superintendence of the Chief Clerk, O. B.
Brown, who s tall be tho Treasurer of the Depart
ment. There shall be under his control the “ Book
Keepers,” the “ Solicitor’s Office,” tiie “ Pay Of
fice, the “ Examiner’s Office," the “ Register's Of.
fice,” rad the “ Dead Letter Office,” to the lost of
which shall be attached the business of the general
letter file.
9th. No money shall be paid into the Department,
directly to the Treasurer, nor paid out of it, directly
by him.
I9th. When payments are made for transportation,
either to meet drafts made by Contractors, or to be
forwsrded to them, the principal Pay Clerk shall fur.
nish the Treasurer with a list of the checks required,
having his certificate annexed that it is correct. The
Treasurer, if ho approves the list,shall add the word

(among other things) conveyed to your petitioners

Georgia, to wit: Lot number two in tho Town of
Gainesville, being the House and lot then occupied
by the said Thomas S. Tate, and lot number twenty,
eight in the town of Gainesville, then occupied by
the said Thomas S. Tate, for a Gin-House lot, which
two togm lots were mortgaged by the said Larkin
Cleveland and Thomas S. Tate, for the letter secu
ring to your petitioners the payment of a certain
promissory note made and delivered to your petition,
ers (by the name and style of W. and H. Bryson) by
the said Larkin Cleveland and Thomas &. Tate, for
the sum of two thousand eight hundred and sixty-tivi
dollars and forty cents, dated on the seventh day of
May, eighteen hundred and thirty two, nd due on#
day after date, and which is here in Court shewn,
(and which was to be paid to your petitioners on the
first day of March next thereafter, with interest from
date.)
And your petitioners further shew that the whole
amount of principal and interest on said note is now
due and unpaid : Wherefore they pray, that unless
the said Larkin and Thomas S. pay into the Clerk’s
office of this Court the amount of tlic principal, in
terest and cost tlue thereon, within six months from
this date, the equity of redemption in an i to the
mortgaged premises thenceforth and forever l>c fore,
closed. ^
Therefore, on motion of counsel for plaintiff, it is
ordered >v the Court, that tho said Larkin Cleveland
and Thomas S. Tate, pay into the Cler'.’s office of
this Court, tho amount of the principal ana interest
now due on said note, together with all legal cost,
on or before the expiration of six months, otherwise
the equity of redemption in and to the mortgaged
