By consent oflbe parties, in each of the above stated
causes, by their respective Counsel,
It is ordered, that the said two causes he tried togeth
er, and that the Judgment, nnd Order, and Decree f
this Court, shall apply to nnd he binding in each case,
and ha so certified to the Court below.
This cause came on to be heard on the transcript of
the Record froth the Superior Court, of the county of
Bibb, and was agreed hy Counsel, Whereupon,it is con
sidered, and adjudged by thr CeOrf, that the Judgment
of lJm Court below be reversed on the follow ing grounds:
First. —Because it is the opinion o/ this Court, that
the Bill holders bad n paramount lien only on the Fund
raised by the sale of the Railroad from Macon to Griffin,
ana sp much only ofthe Road from Griffin to the termi
nus, in DeKalh, as was bniji by the Monroe Kail Rqsil
and Bunking Company, prior to the 2d day of, August,
1842, and that the Contractors of the second par; under
the agreement of the. 2d August, 1842, in the Record
mentioned, had a prior and,superior Equity to the Bill
holders to be paid out of said fund, in proportion to the
relative value of the work done by them on said Road,
ami ma(trials furnished bet ween Griffin and the termi
nal ofthe Road, in the GOftnU of DeKalh, and that the
Court below committed error In excluding said Con
tractors Jrmn a participation in paid fund to the extent
of the relative value of their claim for work.and labor

between the city of Griffin uud the terminus of tin*. Road

It is further the Judgment of this Court, thnt the ret

tractors, between the. places Ihsl aforesaid, he apportion
ed by three Commissioners to be appointed by the Court
below, with power to hear evidence in relation thereto,
and make report thereon within such time ns lo the said
Court shall deem expedient. *
Second.—Because the Court Itelow committed error
in deciding ‘‘That the Bank Bills should take each in *
proportion to the value received bv the Bunk for it at the
time of its emission by the Hank. 1 * It being the opin
ion of this Court, that each Bank Bill should take in
proportion to the quantum of consideration paid there
for hy the hopler or claimant on die Fund, und that such
holder or claimant should state the quantum of consid
eration actually paid therefor, on oath, Tn writing, with
tho right of other contesting claimants for said fund to
traverse the same.
