It is ordered, that the said two causes he tried togeth
er, and that the Judgment, and Order, and Decree of
this Court, shall apply to and be binding in each case t

This cause came on to ho heard on the transcript of
the Record from the Superior Court, of the county of
Bibb, and W as agtired by Counsel, Whereupon, it is con
sidered, ami adjudged by the Court, that the Judgment
of the Court below he reversed on the following grounds:
First.—Risen as* it iA the opinion of this Court, that

raised by the sale of the Railroad from HA cob to Griffin,
ami so niiich only of the Road from Griffin to the termi
nus, in DeKalb, as was built by the Monroe Kail Hoad
