There was but very little business transacted in tbia
Court on Saturday last. The case of a negro, named
Perry, charged with having in his possession a mule,
toe property of James O'Brien, occupied nearly toe
tire day. It appears that the mule waa stolen about
three weeks ago. It waa found in toe possession of
Mr. Fulton, who hsd bought it from s negro named
Perry, who in turn, had got it froto a negro named
Marshall. The negro Perry was on trial for toe steal
ing of the mule. In toe course of toe evidence, it ap
peared tout Perry had originally gotten the mule from
Marshall. He had been arrested and taken to toe
Court House in charge of one of toe negroes employ*
thereabout, but bad been allowed to depart through
toe interposition of Detective Cody. On Thursday,
this happened and that same night Mr. Cody
dered to hare bun re-arrested.
At toe trial on Saturday, after hearing toe evidence
in the case, Mr. Cody was put upon the stand, and
testified that, according to orders he had tried to make
the arrest of toe negro, but he had been set upon by
the negro aud his friends and had been injured in toe
arm which he carried in a sling.
In rebuttal. Judge O'Byrne, counsel for the defend
ant produced a wiuieaa who testified that he waa toe
person who had iutiictod toe injury on the arm of Mr.
Cody, and that between toe hoars of ten o'clock at
night and one o'clock in toe morning, Cody waa in
such a place that he could not possibly have tried to
arrest toe negro.
In summing up counsel animadverted upon the tes-
timony of this witness and his general character for
reliability and showed by testimony tout what he l—’
testified to was not correct, and asked for toe acquit
tal of lus client. Judge Bronson held toe matter un
der advisement.
The Charges Against Duncan.
J. W. Duncan, now confined at the jail awaiting his
trial before the military commission on charges arising
from his conduct while an officer in the commissary
department of toe Andersonville prison, was taken be
fore toe commission on Friday for a preliminary ex
amination. Judge D. A. O’Byrne appeared for toe
prisoner. The charges were read to toe accused and
are in substance as follows :
Charge 1. Murdering an unknown man belonging
to a Tennessee regiment while a prisoner at Ander-
sonville, about toe both day of June, 18G4.
Charge 2. Violation of toe laws of war in robbing
Jas. Armstrong, a prisoner of war belonging to an
Ohio regiment, of U. S. Treasury notes of toe value of
£8, and a likeness or picture of toe value of J1, at An
deraouville prison in October, 1864.
Charge 3. Violation of the laws of war, in violently
and cruelly beating a prisoner at Andersonville, in
flicting serious hurts and Injuries upon him, though
toe prisoner was an Idiotic or half-witted person, and
utterly inoffensive and helpless. This at Anderson-
ville, on or about toe I6to of Jane, 1864. <
The prisoner made an affidavit that his material wit
nesses were prisoners at Andersonville, and tost they
would prove his innocence. The commission there
fore allowed a continuance of toe case for toe purpose
of obtaining too desired witnesses on behalf of toe
prisoner.
