See. 2. And be it further enacted, That there
•hall he levied, collected »nd paid, on each
and every nou-enumentted article which bears
.similitude, either in material, quality, text
ure, or the uses to which it may be applied, to
any enumerated articles chargeable with daty,
the aatne rate of duty whieb ia levied and
charged on tbe enumerated article by the fore
going schedule# which it most resembles in
any of the particulars before mentioned; and
if any non-enumeraled article equally ;
bles two or more enumerated articlM on whioh
different rate* of duty are chargeable, there
•ball be levied, collected and paid on such
Don-enumerated article, the same rata of duty
aa is chargeable on tbe article wbioh it reaam-
payiog the bighMt duty. Provided, that
•mall articles manufactured from two or more
materials, the duty shall be assessed at the
highest rates at which any of it« component
parts may be chargeable. Provided further,
that on all articles which are not enumerated
in the foregoing schedules and cannot be class
ified under this section, a duty of 10 per cent
ad valorem shall be oharged.
8ac. S. And be it further enacted, That all
goods, wares, and merchandise, which may be
in the public stores as unclaimed, or in ware
house under warehousing bonds, on the 31st
day of August next, shall bs subject on entry
thereof for consumption, to such duty as if the
same had been imported, respectively, after
that day.
8ao. 4. And be it further enacted, That <
entry of any goods, wares, or merchandise, im
ported on or after the 31st day of Auguat afore
said, the decision of the Collector of the Cus
toms at tbe port of importation and an try, as
to their liobilitv to duty or exemption there
from, shall bo final and conclusive against the
owner, importer, oousiguee, or agent of any
each goods, wares and merchandise, unless the
owner, importer, consignee or agent ahall,
within ten days after such entry, give notice to
the collector, in writing, of his dissatisfaction
with such decision, setting forth therein dis
tinctly and specially his ground of objection
thereto, and ahall, within thirty days after
data of such decision, appeal therefrom to tbs
Secretary of the Treasury, whose decision on
such appeal shall bs final and conclusive; and
ths aaid goods, warm and msrehandiss shall
bs liable to dutv or exemption therefrom aa*
cordingly, any Act of Congress to the contrary
notwithstanding, anises suit shall be brought
within thirty days after such decision, for any
datiM that may have bean paid, or may there
after be paid, on said good*, or within thirty
days slier the duties ahall have been paid in

lawful for the owner, consigns#, or agent of

or procured otherwise than by purebaM, on
