In iny Insi letter, Sit, I submitted lor your
solution, a proposition which appears in me lo
place you in coniiderable difficulty. A lionio
the foils might, in perfect consistency with hit
character, decline ulj means of escape through
fear of committing his dignity upon an unsuc
cessful effort. In’ older that' I may reconcile
you lo this course, (belicveing ibal you ale al
ready determined on pursuing it,) I proceed lo
show you that you could not escape, ifyou would.
You will ptrhapt say, that although a State
has a right to pronounce on the conniiutiunali*
ty of an act of Congress; yet it is, nevertheless,
boot’d to submit to his net so pruuoiinced to ha
unconstitutional until the other States shall
have sanctioned its decision This, il it were
true, might perhaps afford some ground of apol
ogy lor (lie President and Congress. It is this
which 1 have already alluded to, as presenting
the only possible chance of escape from tho
horns of my dilemma. Indeed Sir, it may ho
useful for you to know, that a great many ofthe
most vociferous denouncers of nullification go
with it, in perfeci fellowship, until it reaches
this point. I will endeovor now to show you
that there is no sort of reason for separating
here; mid if I should succeed in this effort, you
may rely upon it, that a vast number who are
now in your rhnka, will desert lo mine. I af
firm, therefore, that ibe resolutions of 1798, to
far from comlcnancing the idea that a Slatt
which hat pronounced an act of congress to be
unconstitutional, is bound lo obey that law, ws*
til the other Slates shall sanction its decision,
do distinctly assert the precise reverse. This, I
doubt noi, 1 shall prove,
I presume it will readily be admitted, that
Madison’s Report which was mode expressly to
sustain those resolutions, is a fair interpreter, of
their meaning. That report, after stating I ha
proposition, that “where resort can be had 10
tribunal superior to the authority of the parties
the parties themselves must be the judges ia the
last resort, whether the bargain made has been
pursued or violated,” proceeds thus. “The
Stales, then, hiring the liariies to the constitu*
liorthl compact, and in their sovereign capacity,
it follows, of necessity, that there cap be no tri
hunal ubnve their ■ authority to decide hi the
last resort^ whether the compact made by them
be violmed; and, consequently, that, as the par
ties to it, they must decide, in the but resort,
such qnestidns ns may be of sufficient magnitude
to require that inierpo-iiion. From tbit vtesr

from usurped power, and a direct subversion of
the rights specified or recognized under all the
State Constitutions, as well as a plain denial of
tho fundamental principle on which our iudt-
pnndence itself was declared.
This language appears to me to be plain *n-
ougli for any common understanding. It even
goes a bowshot beyond the nullification of Sooth
Carolina, That State admits that the other
Slates, acting as such, may ovorrulp her decis

impregnahly Intrenched. If, then, ihe'resoln-
lions do not contemplate the interposition of
each Stale for itself, they must contemplate such
