Frying Ecgs.—Schaeffer, the dancing
master is now dead; but the memory of
his waggery has survived him, lie was
once a hoarder at the Lamp Tavern, Bos-
ton when that bouse was tho resort of sun
dry gentlemen of the Legislature. A par
ty of the last had returned, ono ovening,
from ouo of Potter’s exhibitions; and
while talking over what they had seen, in
prosenco of Schaffer, confessed that no
thing puzzled them so much as the feat of
frying eggs in a hat. The modus operan•
di of Poller’s oilier tricks they llioughl
they had detected; but this particular feat
quire exceeded iheir comprehension.—

ments lit the rueful plight of (he chapeau,
Schaeffer, recovering from his apparent
astonishment, at length exclaimed, “Well
gentlemen, 1 am sorry to say it, hut I
have lost my bet. But, I declare 1 thought
I could do it.”

You have been, Sir: exceedingly unsparing i n
your denunciation of nullification, MP] do not
recollect that you have eVnr offered a single nr-
guinenl against it. you have, indeed, abused Mr.
Calhoun, until even his worst enemies are ready
to take sides with him, from mere sympathy wilft
the persecuted und oppressed. That such a man
should be borne down before an intelligent peo
ple, by a man of Andrew’s Jackson’s pretentions,
is a moral anomaly, worthy the especial noiico of
the future historian. You appear to have thought
that ir was enough to destroy John C. Calhoun,
and nullification must fall of course. This is u
mistake. Tho doctrine did not originate with
him, does not depend on him fur iu support, ami
will not die with the denih of his onfluence. You
may, therefore, spare him without (ear that such
a tribute todecency will affect nullification oiihor
one way or the other. It would certainly have
been much more worthy of your standing among
our public journals, if you hud attempted to en
lighten our uudei standings, instead of appealing
to our partisau feelings. The huzzas of man-
worship are alike degrading to the press, and in
sulting to its supporters, instead of proving that
nullification is wrong, you have wisely, perhaps
but not generously, it is certain, contented your
self with effort* tu prove that the nuliificrs are
wrong. This was, beyond all doubt, much the
easier task of the two, but, unfortunate, v, the mass
of your readers have not su understood you.—
Your paragraphs have been so contrived as to bo
generally recived as an utter denunciation of
South Carolina, aud her whole doctrines und pro
ceedings together, at tire same that their strict
letter will allow you to say hereafter, thatyour re
proaches were meant, not for tho doctrine, but
ouly for the particular mode of asserting it. Jt
always gives ine pain to see an influential public
journal dealing Wilh its readers in this uncandid
way. Whenever the press yields itself wholly to
party it becomes, instead ol u blessing the worst
possible curse, to a free country. Jt is then dau-
gerous in exact proportion to its influence.—
Whenever the liberties of this country Khali be
overturned, u corrupt aud hireling press will bo
the chief ageut lit the mischief, This, however,
is udegression and it will certainly make no im
pression upon yuu, 1 was going to sey, that
while the principles upon which South Carolina
has proceeded are uudeniubly right, 1 agree with
you, that she has fallen into some very great er-
rots, in her course of proceeding, Ou one point,
I will agree With the President of the United
States, an approximation to error at which I can*
not but feel uneasy. 1 think thut tho tariff lawi
although clearly against the spirit of the Consti
tution, by the gioss inequality of their burthens,
are yet not so “ palpably” unconstitutional as to
call for nullification, nor so “ dangerous” os to
demand secession, until every hope shall be lost,
that Congress will modify them. I, therefore,
may well censure South Carolina in this respect,
bur you cuimolt for you prufess ro const.:-,• ihusn
laws altogether and unequivocally nnconsiiiuuon-
al. I think also, that south Carolina appointed
too oaily a day lor tho operation other ordinance.
1 think, also, that some of her enactments for
enforcing thut ordinance are too rigorous, and
probably are themselves unconstitutional. And
I have another objection wtrich J have not yet
seen staled iu any uowspnper. The principle*
upon which nullification proceeds, demand that
the uullifiyng States shall refer her decision M
convention of the other States—and that she
shall give way, if such Conventions overrule her.
In evory case, therefore, which will admit of it,
she ought to tuke cure that the other Stutes sustain-
no injury from the suspension ot rho law by her.

in case her decision should be overruled. In the
present case, tile injury would consist in the loss
of duties, aud therefore, South Carolina should
merely have suspended the payment of duties,
and should have guaranteed the ultimate payment
of every cent of them, in CBsb the other States
(nnd a bare majority ought to be sufficient)should
decide the tariff laws to be constitutional, and she
should thereupon determine not to secede. In
all these respects, und perhaps in others, South
Carolina appears to me to have acted unadvised-
ly. Suppose, however, that she had avoided all
these errois, would it not have been nullifications
still! And with wliut could you then have re
proached hcrl Suppose that, instead of the tar
iff laws, she hud nullified a law declaring all the
slaves to be/reel Would you not have com
mended her extraordinary moderation, aud her
scrupulous respect for her co-stales; in siibmiting
to them the question of tho censtitutionality of
such a law, involving directly the highest of her
rights ? You cortainly would, Sir; aud wherein
then, consists the difference! Simply, Mr. Rich
ie, in the application of the doctrine, and not in
the doctrine. Hereafter; Sir, when yqu de
nounco nullification yon should say in unequivo
cal terms (lint it is not nullification in itself, but
South Carolina nullification, which you mcun
to condemn. You may then come back (as come
back you must, aud-ahoi tly loo,) to the doctriues
of the Constitution, with better place.
And now Sir, us South Carolina is undeniably
right in her principles, and merely wrong iu some
of the mensuters by which site endeavored to as
sert thorn, docs she for this deserve a aword or
not! 1 have heard the lawyers say, that you
do not forfeit your claim in a court of justice by
suffering a tion-suit for bringing your action
wrong ; and 1 imagino that this would be equally
true, if tho non-suit subjected your adversary to
the costs. It is perfectly clear, that you caunot
coerce South Carolina, without placing the au
thority of Congress above that of the States, de
ciding on the extent of the powers of Congress
itself; and, of course, you thus destroy the right
ofthe State altogether, This seems to me be
altogether too high a forfeiture to be incurred
for a mere error in the forms of asserting a right.
And besides, Sir, do you perceive no danger to
the Constitution in the extraordinary power*
which you are asking Congress ro confer upon
the President! It is not enough tossy that these
powers are only to be exerted contingently—since
lire hill now before Congress leaves it to the
President himself to determine when the contin
gency may arise. It there no danger that, if it
should not arise in the ordinary course of events.
