Georgia Railroad aud Banking Company.

it does not appear thut it passed by a majority
ol two third- in each bouse, as required by the

ieges ol the Company should be renewed, till
it will consent to lebnquish thecxcmpilou irorn
taxation upon the Road and other property ot
the Company which is contained iu tbeoriginul
('barter. At the lime the charter was granted,
the present condition of the connt.y, with a
high taxation,tin pobed upon till other property,

us the Slate is under no pledge, express or im
plied, to renew the charter, shuiios the right to

I lutl it my duty to relate my usaunl to the
bill which on gin a ted In the House, entitled an
act to au bonze tbo tax payers of the Slate lo
pay their Slate and county lux In Confederate
Treasury notes and lor other purposes.
The lull declares that the “tux payers ol ibis
State uuy pay their State und county taxes iu
the Treasury Notes of the Confederate Mules,
aud the Tax Collectors oi the several counties,
ure hereby authorized and required to receive
i vid notes when lendeie.il m payment ol taxes."
1 u this, there is no objection; but it gives the
t ix payers no privilege which they do not al
ready enjoy, a * the State has received Confede
rate Treasury Notes 1 or nil taxes and other pub
lic dues from the lime the tirst note was ten
dered to her Collectors till the present day.
I presume, however, thut the exception which
follows the language above quoted, is the main
object of the bill. It is iu the following words :
“Except such persons as may, alter ibis aet
shall leave gone into died, refuse to receive
C«nle(&iulc Treasury Notes in payment ot any
claim due them in their individual capacity, or
as a corporation, or agents, or who shall reluse
to i eceivn Coulederato Treasury Notes inpay
ment for produce or merchandize, iu which
ease, the tax due on such claim, or produce, or
merchandise, sbull be payable la specie; pro
vided, this exception shall not apply lo promis
sory tiyces payable iu specie, and so expressed
ou tbo luce."
The Constitution of the Confederate States
declares that uo State shall “make auylbiug but
gold aud silver coin a teuder itj pay in cut of
debt," or pass any “law impairing tho obliga
tion of contracts.”
The pa-sige ol this bill is a legislative attempt
to do indirectly what the Constitution declares
sh til not be done, make Confederate Treasury
u*>t('S u lender iu payment of debts, iu the
pre-tent state of the currency it is u heavy penalty
lor the Slulo lo compel one of her cilizuns to
pay his tax Iu specie when others pay in Con
federate Treasury notes. This hill, then, pro
poses to compel creditors lo receive Couledeiule
I ruasury notes as a legal tender in payment ol
debts under a heavy penally for refusal. If the
State has no right to make anything but goto
and silver coin a lender iu payment of debts,
ins she a right lo impose penalties upon credi
tors lor relusmg to receive anything else in pay
ment T H no, all that is necessary is to declare
what else-ball be a legal teuder, uud make the
penalty heavy enough, uud she compel-* her citi
zens to receive it as a lender in puymcui ol debis
due them. Again, no Suite shall pass uuy law
impairing the obligation ol coutraeis. A pur

B to receive the money or submit to a severe

the contract, and is it just ?
But, aside from coualiluitonal objections, this
bill ought not to become a law, mb it euu liuuctil

This bill propos s to inflict the same penally
upou him who lefuses to receive Confederate
'1 reasury notes lor prodtueor merchandise us il
does upon him who refuses lo receive it in pay
ment of dubl^giveu lor properly on the specie
basis. But il does not say what price persons
may charge in Confederate notes lor merchan
dise. If they price produce or merchandise
worth live dollars :»L eighty dollars aud receive
payment in Confederate notes when tendered,
they escape the penally. Then why not permit
the owner of the promissory note lo pi ice his
note at its value in currency, and punish him
only whou he refuses to receive its value iu
Confederate notes when tendered V
Again, the act excepts from Die penally those
who refuse to take Confederate Treasury notes
in payment lor “promissory notes payable in
specie aud so exfiretsod on the face." Muuy
persons linvu tipfrowed gold aud given nolo*
lor il who have not expressed iu the face of the
notes thftl they are payable in specie. 11 two
notes ot equal umouul are given tor gold lent,
aud oue says upon its face payaule iu specie,
and the other limply says lor valuw received,
aud the holder reluscs lo take Confederate

the Justice ol compelling one lo pay his tax iu
specie, whilst the other is permitted to pay iu
treasury notes, because his note chanced to
have on its luce the expression “payable In
specie." Nor do 1 see the equity ol the diU'cr-
ence in any case where the note is given lor
specie value, whether expressed iu the face of
the uo to payable iu specie or nut.
But il may be said there are pi iuclplcrf of pub
lic policy which override private interest; aud
thut the public safety requires that tho eurreuey
bo sustained, aud treated as gold in all indi
vidual payments. Public policy and Justice re
quire that the currency be received at its mar
ket value. No more, uo less. And in this con
nection it should uol be lorgutluu that
the Confederate Congress does not estimate
it as eqaivalent to gold, but draws a
clear distinction by compelling the holders ol
gold lo give in and pay Confederate lax upon
the value ol the gold iu Confederate Treasury
notes, und the Couledeiule Collectors have es
timated the difference at eight and leu lor oue.
We need not attempt to shut our eyes to a lacl
well known to every iiitelligt-ut man, woman
aud child in the Confederacy, and to our ene
mies, and which is at-kuowledged by the Con
federate C»ugre68, that the Conlodurule cur
rency is greatly depreciated, and that Confeder
ate Treasury notes are uol worth par in specie.
It would be wiser to ackuowlcdgu by "our legis
lative uctiou what all our constituents know,
aud to use all cousliiutioiial and proper means
by tux itluo and otherwise to Improve the cur
rency than to attempt to sustain its value by
compelling one cluss of citizens to receive it as
gold, und permitting all others lo treat il us of
but little value.
If ibis bill had excepted all notes given for
Bpecio value prior to the depreciation ol tbo
currency there might have been some justice iu

Douglas :
Colonel—Hereafter you will permit prisoners
of war lo receive such articles ol clothing as
may be absolutely necessary only Iroui their im
mediate families—nol Iroui tnelids or sympa
thisers. Il a prisoner has u suit which he can
wear, nothing more cam be given lo him.—
Boxes of clothing, or other articles of couiribu-
liou, will not be received, uor will you receive
contributions of liquors for the sick. What
ever is'nucessuiy and proper will be obtaiued
on icqUisilion made on the Medical Department.
You will not receive or iTepimit lor any one per
son morn than teu dollars, unless it is fouiiu in
bis possession when he is delivered to you.

A friend at Mobile sends us the following bit
ol cbeeriug news, which, if true, is important
as well as cncouruging. The dispatch is dated
at Mobile, Dec. 20 :
Editor* Appeal: Col. Reed, of the 12ih Ar
kansas, captured at Port Hudson, has just arriv
ed at Jacksou. He tuu0u his escape Horn New
Orleans on Monday last, and says the negroes
bid rebelled in Fort Jaekson and liberated the
Confederate prisoners, aud bad killed tweuly-
lour out of thirty Yaukcu officers. The Fede
ral bud scut guulmuls down, one of which bad
been sunk. Col. Reed stales this officially, and
that the negroes held the tort.

volted and massacred their Yankee officers—

this uews was credited by Ool. Forsyth of the
Advertiser and Register. Hurrah I uud thrice
