Mr. Kirkland submitted for consideration
the following resolution :
Resolved, Tiro the Committee on the Ju
diciary he instructed to inquire into the ex
pediency of providing hy law for the pun
ishment of such officers of the United States
as are cntriMed with public monies hy vir
tue of their office, who shall apply the same
to any purpose or purposes incompatible
with the duties of their office, whereby the
United States shall sustain a loss.

Mr. Bassett was in favor of the resolution,
hut wished to extend it lo those who had the
public property in keeping, and he proposed

A Jr. Hardin was apprehensive that the
punishment which seemed to be contempla
ted hy the gentleman from New-York (Mr.
Kirkland) would lie found too severe—mil,
in mieh cases, a law, if too severe for public
sentiment to sustain, would become a dead
I,.Iter. Mr. M. did not think public senti
ment was such as to brand the public de
faulter with infamy. On the contrary, the
proceeds of his defalcation support him and
enihle him to drink his ivine. and give his
dinners : nor would it be possible to put a
mail in the penitentiary merely for lining a
defaulter. Mr. II adverted particularly to
the case of the District Attorneys, & thought
the only course in relation to them would he
to nake them give bond for the faithful pei-
f.i; malice of (heir duties, and also to require,
if they fail to account, that that failure should
vacate their offices,
Mr. Walworth moved to insert the words
« or agent" after the word “ officer,” which
Was assented to I’}' the mover.
Mr. Smith moved fuithe.r to amend the

prohibitum so far. If tun officers and agents

We have published in this paper from
time to time, resolutions adopted in the
Mouse nf Representatives of the United
Slates, nl the instance of a Mr. Cook, a
member from the State of Illinois, calling on
I lie Secretary iff the Treasury for informa
tion respecting the inspection of certain
Land Offices. The repeated calls for infor
mation by this gentleman, were accompani
ed with insinuations, obviously intended lo
make on the public mind an impression un
favorable to Mr. Craw ford, and also towards
Mr. Thomas, a Senator in Congress, who
had been employed by the former to inspect
■mine Land Offices to the Noi l li West.—
The hurl lien of Mr. Cook’s complaint was
finally submitted to a very intelligent and
respectable committee, (of which he was
chairman) to invr-tigate the merits of the
ease, and Mr. C>. has now the mortification
of making to that Mouse, before whom Ids
illiberal s ispirinns had so often been repeal
ed, a Report, concurred in hy every mem
ber of the committee but himself, after a
fair Ik. ful! investigation oftlie subject, which
entirely exculpates from censure the high
Officer, whom his malice nr liis Jesuitical po
licy would have sacrificed. As if resolved
to dissipate every shadow of doubt in re
gud to tiie character of tile motiv es that in-
lluenced his conduct, Si with mure assurance
perhaps than discretion, Mr. Cook, endea
vored lo substitute for the report of the Com
mitter, after it had been read in the Mouse,
a resolution of his own, by which he aimed
to get rid nf this unprofitable business hy
giv ing a kind of side-blow to the Secretary
of the Treasury, over the shoulders of the
other Heads of Departments. But tin-
Mouse will not, we trust, suffer him to make
his escape in this way, but compel him to
swallow the “ hitter pill” manufactured hy
his own committee. In eur nevt paper we
shall publish the whole report, which con
cludes in this satisfactory manner :
“ Oil the whole, the committee have seen
nothing in the case submitted to them, which
can lead tn the presumption, that either of
the individuals concerned h nl any intention
either to violate the provisions of the law. or
to abuse or disregard tlic spirit and policy of
bur institutions.
“ They are of opinion that the employ
ment of Mr. Thomas to examine the land
offices, originated in a desire honestly to dis
charge an important public duty ; that the
peculiar importance oftlie trust at the time,
and the character and elevation of the indi
vidual employed, were calculated rather to
invite than forbid the selection. Nor have
the committee any reason to believe that the
duty has not been faithfully performed, and
in a manner conducive- to the public good.
Under these circumstances, and with
such impressions, thceommilteo donut deem
it necessary to single out this case for pnrti-
ilar animadversion, or to pronounce upon
the CO uprohensiveness or precise import of
the act of 1801!. They content themselves
with referring to the construction which it
has uniformly received in practice, and to
the conviction that the public good, and not
any sinister or improper purpose was intend
ed ; and they therefore recommend the fol
lowing resolution :

Be il enected by the Senate and House
of Representatives of Ike United States of
America, in Congress assembled, That
the act, entitled “ An act to provide for
persons who were disabled hy known
wounds received in the Revolutionary
war,” passed on the tenth day of A|irii,
one thousand eight hundred and six, and
limited as in said act declared, to the
term of six years, anti afterwards re
vived and continued in force for and du
ring' the term of six years, by an act, en
titled “ An act to revive and continue
in force 11 An act to provide for persons
who were disabled by known vvoutti
received in the Revolutionary war, and
for other purposes,” pissed on the
twenty fifth day of April, in the year
one thousand eight hundred and twelve,
and afterwards revived and continued
force for the term of one year, by an
act, entitled “ An act to revive and con
tinue in force an act, entitled “ An act
to provide for persons who were disabl
ed by known wounds received in the
Revolutionary war,” passed on the fif
teenth day of May, in the year one thou
sand eight hundred and twentj, shall he,
and the said act is hereby, revived and
continued in full force and 'fleet, for
and during the term of six yiars from
and after the passing of this act, and
from thence unto the ptul of the next
session of Congress ; Provid'd, Thai
any evidence which has been taken to
