are less dependent upon their income from
year to year. The national wealth of Eng-

cumulated capital, and current income.—
Tile one may soifer in the vicissitudes of

ia a rich society will maintain a large
consumption for many successive years.
l!i;l in nil new countries, like America, the
national wealth consists in little more than in

di'nivitig of income is with them reduction to
poverty.
Tics rendition nf America, lends to ano-
flier important conclusion, and to one more
, "mediately hearing upon our foreign rela

ni'ticd revenue of the United States, about
tiu nty live million dollars, eighteen millions
are raised by her customs. Of so much im

of her customs, or in other words, the con

COLLISION OF JUDGES.
Judge I’m'ker of Missonii “ has decided
in the St. Louis Circuit Court, in the case of
Glascock against Steen, that the act of the
last session of the Legislature, providing for
., stay of (rcculionfar tica years and a half
(ifthe plaintiff will not endorse that he will
take the property at two thirds of its valye,)
is unconstitutional.” An execution has been
taken nut against the body of Steen—but
the Shei'ifl’made a special return tlmt the de
fen,laid bad given ., bond ivilt, .suflH h i.ise
eurity in conformity with the act of Asscm-
neighborhoods. More unfavorable prospects 1 hiy—and therefore lie had not taken the bn-
for the planter, could hardly, at this season,
be imagined. To th t industrious, whose, la
bor has been partially, if not entirely, des
troyed, there is yet ho,vever tittle enough,
with the blessing Of Providence, to make a
good crop.
05*The f iling man, Bennett, who late
ly petitioned for the exclusive privilege of
navigating “that portion of earth’s atmos
phere which presses the United States,” has
had his right to the discovery contested hy
a Air. Lee, whose petition has been present-
crf’tn Congress, claiming priority of inven
tion, ami charging Bennett with having bor
rowed or stolen Ills secret. Itis aptly pro
posed in the Washington Gnzettn that the
dispute between them he settled hy an wrial
combat, in their respective machines, at a
convenient elevation from the earth, in the
presence of the committee tu whom the sub
ject is referred. Jesting apart, is not the
dignity of the Legislative Body, hy the re
ception and referreiiec of such idle petitions,
eomproniitted ? Or is it, that the llm
not to he outdone hy !he Senate, wltograve-
ly listened to Joint Gloves Symon s promis
ed exploration of the interior of the globe
from an aperture at the North pole, are re
solved to give countenance to some other
chimera, altogether as extravagant and ini -
probable? If there he no hi tier employ
ment for them, il is sorely time for Congress
to adjourn. Have they any thing further to
d-n w orthy of themselves and of the Nation'-
If so. I t it ho done with doe diligence, and
without trilling w ith the public treasure, or
with the national character. The enron
lagement given to swell idle petitions is pret
tv work indeed for tight dollars per day!—
Those small matters may afford the mem-
h-rs abundant amusement and laughter.—

into custody. The counsel for the plain
tiff objected to this return, upon the ground
that the act was against the constitution
the statu, and moved the court I" issue a new
execution. Judge T. pronounced tile act to
hu unconstitutional and void—and ordered
a new execution. Steen was taken—and he
then applied to John Biee Jones, one of the
Judges 0Tthe Supreme Court, for a writ of
Habeas Corpus. The writ wasgtantvd, the
(roily brought before him—and a motion
was made to discharge him from custody,
rtpon his again tendering bund und security
for tile stay of the. execution—Judge Jones,
ill the course of his opinion, vindicates the
constitutionality of the law—among other
authorities he cites the following :
The Court of Appeals of Virginia, one of
liie most enlighten' ,1 in the. union, have uni
formly acted and decided on the statute
laws of (list state, allowing replevies itml
stays of execution for give.it periods, on pro
per security given :— we have however no
need of referring to the laws and usages uf
any other por tion of the United States than
that of our own.
The Judge finally ordered t'.ia prisoner to
he released.
The l.nulsville Advertiser of the 30th tilt,
touches on another judicial proceeding,
which excites no little interest:
“ We understand that the state of Indiana
has instituted a prosecution hr writ of epw
