Here a purchase is implied, which one
party would mm.o for the other; and it
would be absurd, iiideejl, to say, that tho

To illustrate a right of pre-emption lot us

give a full title to the cargoes before their

cisely the same principle obtained with Eu
ropean nations who settled colonies in A-
merica. To prevent interminable wars a-

by which they bound themselves to each
o: her not to obtain lands from the Indians,
within certain claimed limits; but until the
Indians becumc parties to a treaty, their
jest rights could not be affected.
It is almost unnecessary to add that the
U. S. government under tiie clnims derived
from Georgia aud other stiftes to lands, has
never contended for more t han tho pre-emp
tive right and capable of excluditig other
civilize d nations from becoming purchasers
